The following action was taken by the Board of Town Trustees during
their regular meeting held on July 27, 1987 regarding the above matter.
WHEREAS, the Board members have personally viewed and are familiar with
the premises m question and the surrounding area, and
WHEREAS, the Board considered all the documentation submitted concerning
this request, and
WHEREAS, the Board made the following findings of fact:
1. By this request appellant requests permission to construct 184~+ of 20"
high timber retaining wall as a border between a lawn and a stone area.
Work ~s entirely landward of an existing timber bulkhead.
2. The property is located at 10090 New Suffolk Ave., Cutchogue.
3. The project will not affect the health, safety or general welfare
of the people of the Town,
NOW, THEREFORE BE IT
RESOLVED that Roy L. Haje, Pres., En-consultants, Inc. on behalf of Donald
Brennan Be and Hereby is Granted a Waiver as aforementioned and all in
accordance with the plan submitted with the application on July 13, 1987.
Please contact the Building Dept. for a determination on the need of
any other ~wn Permits that may be required for this project.

WHEREAS, Costello Marine Contracting Corp. on behalf of Donald Brennan
has heretofore applied to the Southoid Town Trustees, pursuant to Chapter
44 of the Code of the Town of Southold for permission to install a 40' jetty
approximately 25' north of the east property line and install a 70' jetty 40'
south of the northeast property line on property located at 10090 New Suffolk
Avenua, New Suffolk,
NOW THEREFORE IT IS RESOLVED AS FOLLOWS:
1. Pursuant to the proviszons of Article 8 of the Envimonmentak
Conservation Law; Part 617 of Title 6 of the New York State
Code, the Southold Town Trustees, as lead agency, does hereby
determine that the action proposed is a Type I action and ms
likely to have a significant effect on the environment.
2. That the Clerk to the Trustees shall file and circulate such
determination as required by the aforementioned law, rules and
code.
3. That the Clerk to the Trustees shall immediately notify the
agent on behalf of the applicant and further reques~ said
applicant to prepare a Draft Environmental Impact Statement
all in accordance with said law, rules and code.

Further to our letter to you dated June 17, 1986, concerning the status of
the Department of State's review of this project for its consistency with the
New York State Coastal Management Program, this is to advise you that we have
suspended consistency review pending publication of a joint Public Notice by
the U.S. Army Corps of Engineers and the Department of State and submission of
additional information. We anticipate that the Department's review will be
completed within three weeks following expiration of the public notice period.
Although the Department of State does not recommend the use of gro~ns for
the purpose of erosion control, this project may represents one instance where
this type of structure may have minimal effect upon the do~ndrift beach and
therefore could be consistent with the CMP poli~ie~. However, several project
design and layout questions are of concern to this Department. Would you

On a motion made by Jeanne Marriner, seconded by John Tuthill, -it was
RESOLVED to recommend to the Southold Town Trustees DtSABPROVAL
of wetland application No. 369 submitted by Joseph A. Barbato
to extend an existing jetty to 48' and install a new jetty 48' in
length. The Council recommends the applicant resubmit the applicm-
tion without the 20'extension on the existing jetty. The proposed
jetty to be no longer than the length of the existing jetty, the
eaward end should follow the grade of the bottom contour and prefill.
The Council also feels the adjacent neighbors should be notified
and given an opportunity to comment.

On a motion made by R~lph Condit, seconded by John Holzapfel, it was
RESOLVED to recommend to the 8outhold Town Trustees DISA?~ROVAL
of wetland application NO. 372 submitted by Costello Marine Con-
tracting Corp. on behalf of Donald Brennan to install a 40' jetty
approximately 25' north of the east properny line and install a
70' jetty 40' sounh of the northeast properny line. The Council
feels the applicant should resubmit adhereing to the following
guidelines:
1. Jetties should protmude no further than the Mean Low Water.
2. Jetties must follw the presenn grade of the beach.

~n a motion made by John Tuthill, seconded by John Holzapfel, it was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
of wetland application No. 392 Submitted by Mathias Moue to con-
struct steps to beach for private use. The Council stresses that
the applicant should use extreme care to minimize any damage to the
hill during construction.

Motion carried.
On a motion made by Jeanne Marriner, seconded by John Tuthill, it was
RESOLVED to recommend to nhe Southold Town Trustees ~APPROVAI of
wetland application No. 393 submitted by the L~nd Use Company for
Vernon G. Strub to reconstruct within 18", approximately 73' of storm
damaged timber bulkhead. New structure shall be 1' higher. Also
to construc~ a 10' return at the east end and to backfill with approx-
imately 40 c.y. of clean sand.

Downs Creek, located to the immediate east of the applicants
property is currently the deposition site of large quantities of
littoral sand brought in by the tide and currents, especially at
the mouth. The feeling is the jetties will increase the ability
of the tidal exchange. It is expected that the jetties will ~
noticably accumulate sand within a 4 5 month period, therefore
eliminating the need for prefill. The jetties will effectively
perform maintanence on the mouth, and allow for restoration of the
beachfront which is nonexistant at high tide.
The applicant discussed this project with Paul Stoutenberg
before coming to us. Mr. Stoutenberg thought this was the way to
go and you may want to discuss this with him as well.

the applicant should use extreme care to minimize any damage to the
hill during construction.

damaged timber bulkhead. New snructure shall be i' higher. Also
to construct a 10' return a~ the east end and to backfill with approx-
imately 40 c.y. of clean sand.

Suspension of Consistency Review
Further to our letter to you dated June 17, 1986, concerning the status of
the Department of State's review of this project for its consistency with the
New York State Coastal Management Program, this is to advise you that we have
suspended consistency review pending publication of a joint Public Notice by
the U.S. Army Corps of Engineers and the Department of State and submission of
additional information. We anticipate that the Department's review will be
completed within three weeks following expiration of the public notice period.
Although the Department of State does not recommend the use of groins for
the purpose of erosion control, this project may represents one instance where
this type of struoture may have minimal effect upon the downdrift beach and
therefore could be consistent with the CMP policies. However, several project
design and layout questions are of concern to this Department. Would you
therefore please call Mr. Aram Terchunian of this agency at (518)-3642 to
review these concerns.
