WHEREAS, the Board members have personally viewed and are familiar with the premises m question and the surrounding area, and WHEREAS, the Board considered all the documentation submitted concerning this request, and WHEREAS, the Board made the following findings of fact: 1. By this request appellant requests permission to construct 184~+ of 20" high timber retaining wall as a border between a lawn and a stone area. Work ~s entirely landward of an existing timber bulkhead. 2. The property is located at 10090 New Suffolk Ave., Cutchogue. 3. The project will not affect the health, safety or general welfare of the people of the Town, NOW, THEREFORE BE IT RESOLVED that Roy L. Haje, Pres., En-consultants, Inc. on behalf of Donald Brennan Be and Hereby is Granted a Waiver as aforementioned and all in accordance with the plan submitted with the application on July 13, 1987. Pursuant to the proviszons of Article 8 of the Envimonmentak Conservation Law; Part 617 of Title 6 of the New York State Code, the Southold Town Trustees, as lead agency, does hereby determine that the action proposed is a Type I action and ms likely to have a significant effect on the environment. 2. That the Clerk to the Trustees shall file and circulate such determination as required by the aforementioned law, rules and code. 3. We anticipate that the Department's review will be completed within three weeks following expiration of the public notice period. Although the Department of State does not recommend the use of gro~ns for the purpose of erosion control, this project may represents one instance where this type of structure may have minimal effect upon the do~ndrift beach and therefore could be consistent with the CMP poli~ie~. Barbato to extend an existing jetty to 48' and install a new jetty 48' in length. The Council recommends the applicant resubmit the applicm- tion without the 20'extension on the existing jetty. The proposed jetty to be no longer than the length of the existing jetty, the eaward end should follow the grade of the bottom contour and prefill. The Council also feels the adjacent neighbors should be notified and given an opportunity to comment. Vote of Council: Ayes: Ail Mot%on carried. Jetties must follw the presenn grade of the beach. w~th the landward ends no higher than the Mean High Water. 3. The feeling is the jetties will increase the ability of the tidal exchange. It is expected that the jetties will ~ noticably accumulate sand within a 4 5 month period, therefore eliminating the need for prefill. The jetties will effectively perform maintanence on the mouth, and allow for restoration of the beachfront which is nonexistant at high tide. The applicant discussed this project with Paul Stoutenberg before coming to us. Mr. Stoutenberg thought this was the way to go and you may want to discuss this with him as well. Brennan Town of Southold Suspension of Consistency Review Further to our letter to you dated June 17, 1986, concerning the status of the Department of State's review of this project for its consistency with the New York State Coastal Management Program, this is to advise you that we have suspended consistency review pending publication of a joint Public Notice by the U.S. Army Corps of Engineers and the Department of State and submission of additional information. We anticipate that the Department's review will be completed within three weeks following expiration of the public notice period. Although the Department of State does not recommend the use of groins for the purpose of erosion control, this project may represents one instance where this type of struoture may have minimal effect upon the downdrift beach and therefore could be consistent with the CMP policies. However, several project design and layout questions are of concern to this Department. Would you therefore please call Mr. Aram Terchunian of this agency at (518)-3642 to review these concerns.
