Dear Mr. Santo!o:
The Board of Trustees of the Town of Southold would like to request a
thorough investigation into the navigational problems that might occur
should the above application of Joseph Cavalier be approved.
Of all the waters in the town, this area of Mattituck Creek presents
the greatest problem in reference to safety. The Cavalier property
and the Petersen property adjoining it to the east form an abrupt turn
in the channel that, along with the narrowness of the channel, creates
this problem. Fishermen and boaters alike have complained that even now,
without additional boats docked in this area, visibility and maneuver-
ability around this corner are difficult.
We would be more than happy to meet with one of your representatives at
the site to discuss this further, so that all concerned would be in-
formed. We have previously met with Chuck ~tamilton of the DEC in Stony
Brook for just such a purpose and would hope your department would
arrange for a meeting in the immediate future.

expected to accrue from the proposed work must be balanced against its
reasonably foreseeable detriments. Ail factors which may be relevant to
the proposed work will be considered; among those afc conservation, eco-
nomics, aesthetics, general environmental concerns, historic values,
fish and wildlife values, flood damage prevention, land use, navigation,
recreation, water supply, water ~ua!ity, energy needs, safety, food pro-
duction and, in general, the needs and welfare of the people.

A preliminary review of 'the application indicates that an Environmental
Impact Statement will not be prepared. A review of the latest publish-
ed version of the National Register of Historic Places and of the pre-
sence or absence of registered properties or properties listed in
the latest published version of the Register as being eligible for
inclusion, therein, has been made. Presently unknown archeological,
scientific, prehistorical or historical data may be lost or destroyed
by work to be accomplished under the required permit.
The evaluation of the impact of the activity on the public interest
will include application of the guidelines promulgated by the Adminis-
trator, U.S. Environmental Protection Agency, under authority of Sec-
tion 404(b) of the Federal Water Pollution Control Act or of the
criteria established under authority of Section 102(a) of the Marine
Protection, Research and Sanctuaries Act of 1972, as appropriate.
Any person may request, in writing, within the comment period specified
is this notice, that a public hearing be held to consider this appli-
cation. Requests for public hearings shall state, with particularity,
the reasons for holding a public hearing.

DESCRIPTION OF ~DRK
The applicant, Mr. Jose,] Cavalier proposes to create a mooring for
co~uercial vessels in Mattituck Creek~ Town of Southold, Suffolk County,
New York.
The area, as shown on the attached drawing, would be d/edged by clamshell
to a maximum depth of 7 feet below the plane of mean low water.
Approximately 3,000 cubic yards of dredged material, which is 50% sand and
50% gravel, would be removed initially. Future dredging operations would
be performed as required over the life of the permit, 10 years, if issued.
The dredged material would be placed on the adjacent ~upland area, graded
and topped witch bluestone to provide an access drive. ~and parking area.
The shoreline would be stabilized by placement of stone riprap and planting
of Spartina alterniflora in the t~oper half of the intertidal zone. A 4
foot wide timber walkway, supported on pilings, would be installed to
provide pedestrian access~ and two 6' x 40' ramps wou]~d be installed to
provide vehicular access to the boats.
The proposed work would destroy approximately 1500 sg~are feet of S~artina
alterniflora and approximately 4600 square feet of S~artina ~atens. The
applicant would create approximately 1000 square feet of S~artina
alterniflora.
The applicant states the proposed work is required to create a commercial
mooring facility for 2 to 3 cormmercial work beats.

Dear Sirs:
I regret that circimstances beyond my control prevented me from
attending your meeting of April 7, 1982 at which you further discussed
the above referenced application. Captain John Dudley of Northville and
Dr. Thomas Samuels both attended and informed me of the discussion which
took place.
The Board recommends that more of the point be removed so that
vessels moored there will be fnmther south. This poses a problem to
Northville due to the type and size of the craft to be moored .there
and the configuration of the parcel.
As can be seen from the survey with which you have been supplied,
the width of the parcel decreases as one progresses southward. Therefore,
the more of the point which is removed, the closer to the property line
vessels would be moored until the point when they would extend over it
which would be an infringment upon the rights of the adjacent owner.
As presently proposed~ a 30' x 85' barge would be tied parallel to
the main section of the dock. A 20' work boat would be tied to the westerly
25' n-s section of the dock in a n-s direction. Assuming the dock and dredging
were to be moved to the south further, it would not be possible to accomodate
these vessels in this manner. A significant inconvenience of ~r~asting
the smaller ~ork boat to the barge would result where it would have to be
moved every time the barge was moved.
Southold Town Trustees
The amounn of the point to be removed was determined by taking
into account the vessels which will use the facility and the impact of
the project upon navigation and the environment. It can be shown that
vessels to be moored under the proposed conditions will extend ~o further
into the waters of Mattituck Creek than the present shoreline and that
no impediment to navigation will accrue.
Due to these special circzmstances~ we request that you consider
our original application un~hanged.
I shall shortly apply to you and other regulatory agencies
for a dredging and dock project on the Petersen property directly to the
east of the Cavalier parcel. While I can understand your desire to review
both at the same time, I believe it would be unfair to both parties
if approval of one would be contingent upon approval of the other, lhe
proposed usage differs as do other conditions. Therefore, each should
s~and on its own merits.
Please accepn these comments in your further review of the
proposal and contact me with a date for any future meetings.

3. Install 4 ft. wide timber walkway supported on pilings as pedestrian
access to boats.
4. Install two 6' by 40' ramps to provide vehicular access to boats.
5. Spoil to be placed on adjacent upland graded and topped with bluestone
to provide access drive and parkiug area.
6. Install diesel fuel storage tank for use of boats and bring water
power and telephone connections to site, A storage trailor is also to be
placed on adjacent upland.
