RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.

DESCRIPTION OF ACTION: Applicant requests a Wetland Permit to
construct 60 1.f. of timber bulkhead with 2 12' returns and place
approx. 100 c.y. cf clean fill, all in accordance witkNYSDEC Plans
dated 1/5/95.

REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the~Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed.and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

not rrodify, supersede or rescind any order or determination perviously issued by
the Deparu¥~nt or any of tt~ te..~, condit ions or cequi re"~ents contained in suc~
order or determination.

6. The permittee has accepted expressly, by the exec-Jtion of the application, thl
full legal responsibility for all da~uges, direct or indirect, of whatever
nature and by whu~uver suffered, arising out of the project described in this
permit and has agreed to indu.~ify and save harmless the State from suits,

7. This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the r~perian rights of others in order to perform the
permitted work nor does it authorize the irrpai~.unt of any rights, title, or
interest 'n real or personal property held or vested in a person not a party to
the permit.
8. The permittoe is responsible for obtaining any'other permits, approvals, lands,
easu~unts and rights-of-way that ney be required for this project.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
2. All areas of soil disturbance resulting from this project
shall be stabilized immediately following project completion
or prior to permit expiration, whichever comes first. The
approved methodologies are as follows:
a. stabilization of the entire disturbed area with appropriate
vegetation (grasses, etc.).
c. Temporarily stabilized with straw or hay mulch or jute
matting or other similar natural fiber matting within 1 week
of final grading. Temporary stabilization shall be
maintained un=il a mature vegetative cover is established.
3. Ail fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or demolition
debris).
4. No excava=ion of the beach is authorized for the p%lrpose of
obtaining fill or stone materials.

5. Ail peripheral berms, cofferdams, rock revetments, seawalls,
gabions, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
6. There shall be no discharge of rLtnoff or other effluent over
or through any bulkhead or shoreline stabilization structure
or into any tidal wetland or adjacent area.

The following con~_~ions apply to all Tidal .~_t!ands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic,
Recreational Rivers Pe-~nits:
A. A copy of this permit, including all conditions and
approved plans, shall be available au the projecn site
whenever authorized work is in progress.. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
pro]eot engineer, or other person responsible for the
overall supervision of this project reads, understands,
amd complies wi~h this permit and all its general,
special, and supplementary special conditions. ~y
failure to co=ply precisely with all of the terms
conditions of this permit, unless authorized in
wqriting, shall be treated as a violation of
Envircnmenta! Conservation Law. If any of the
conditions are unclear, the permittee shall con=ac= the
Division of Regulatory Affairs at t-ko address on page
one or telephone (516) 444-0365.

along with photographs of t_he completed work and, if
re_cp/ired, a survey.
E. For projects involving activities to be undertaken in
phases over a period of more than one year, the

F. The granting of this pelnnit does non relieve ~he permittee
of the responsibility of ob=a!ning a granu, easement, or
