DESCRIPTION OF ACTIVITY: to construct 100 1.f. of timber
retaining wall attached to return of adjacent wall to be built
on west side. Approx. 500 c.y. of clean sand will be trucked
in for backfill via Bailie Beach Road. West end of wall will
be in tow of eroded bluff which must be regraded as it is now
unstable. In addition, a 4' X 20' section of steps will be
replaced and/or repaired as appropriated and 4' X 10'
retractable stairway added to access to beach.
Date of permit issuance: March 25, 1993
This permit is valid for a period of two years from the date of
issuance.
SPECIAL CONDITIONS:
Bluff restoration through a re-vegetation agreement is
attached hereto and is a necessary special condition of this
permit.
A relocation agreement is attached hereto and is a
necessary special condition of this permit.
A maintenance agreement is attached hereto and is a

PROJECT DESCRIPTION
Re: D. LAWRENCE CATULLO
Construct 100 1.f. of timber retaining wall attached to
return of adjacent wall to east at a point 18" from
corner. 16 1.f. angled return will be built on west
side. Approximately 500 cy of clean sand will be trucked
in for backfill via Bailie Beach Road. West end of wall
will be in toe of eroded bluff which must be regraded as
it is now unstable. In addition, a 4'x 20' section of
steps Will be replaced and/or repaired as appropriate and
4'x 10~ retractable stairway added for access to beach.
Project is an emergency as the 12/11/92 storm caused
severe erosion which is threatening a concrete block
structure which supports stairs.
Directions: Enter client driveway approximately opposite
East Side Road (which has no street sign). LILCO pole 4
is immediately west of driveway and I have placed (2)
closeribbons at driveway. The Catullo property can be
entered through white posts fence which bears left off
driveway. However, for easier access, continue on
driveway to Golds~hmidt house.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on Thursday, March 25, 1993 regarding the
above matter:
WHEREAS, Eh-Consultants on behalf of Dr. Lawrence Catullo applied
to the So~thold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
January 29, 1993 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recon~endations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on March 25, 1993 at which time all interested
persons were given an opportunity to be heard, and,

RESOLVED that the Board of Trustees approves the application of
En-Consultants on behalf of Dr. Lawrence Catullo to construct 100
1.f. of timber retainign wall attached to return of adjacent wall
to be built on west side. Approx. 500 c.y. of clean sand will be
trucked in for backfill via Bailie Beach Road. West end of wall
will be in tow od eroded bluff which must be regraded as it is now
unstable. In addition, a 4' X 20' section of steps will be replaced
and /or repaired as appropriated and 4' X 10' retractable stairway
added to access to beach.
permit will expire two years from the date it is signed. Fees must
be paid, if applicable, and permit issued within six months of the
date of this notification. Two inspections are required and the
Trustees are tobe notified upon completion of said project.

RESOLVED to recommend to the Southold Town Trustees approval with
stipulations of Wetland Application No. 35-5-17 of Joseph and Dorothea
Ger~ci to construct a 6' x 6' cantilever platform attached to existing
bUlkhead with a 3' x 15' ramp leading to a new 6' x 50' floating dock,
and to install three (3) 25' long pilings to secure float,
The Council recommends approval provided the applicant leaves a third
(1/3) of the waterway reserved as "open water", that is, l:he float
and boat must not take up more than one-third (1/3) of the waterway.
This would leave the waterway open for navigation.

~Schle,qal to construct a 6' x 95' fixed dock elevated a minimum of 3.5'
over grade, a 3' x 20' ramp and a 6' x 60' float.
The Council recommends approval provided the catwalk (not fixed dock)
is reduced to 4' width.

Wetland Application No. 37-5-6 of Charles and Rosemary Luscher to
construct a 45' x 3' pier from a point 4' over high water mark on property
to a point 30' into lagoon,
Bayview Drive, East Marion.

On a motion by Stephen Angell, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 56-5-28 of Robert Cockerill to install a 6'
x 15' float with a 3' x 10' ramp.
The Council recommends disapproval of the project because of the policy
of only 4 boats to property, otherwise it creates a "marina". The property
is zoned "R" which does not permit marinas.

RESOLVED to recommend to the Southold Town Trustees disapproval.

need is shown; the property is not in danger. The Council has no

The following recommendations were passed by the Conservation Advisory
Council at~-its February meeting:
On a motion by John Holzapfel, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 119-1-18 of Laurence and Diane Nieblin9
to construct a bulkhead and gazebo.
The CAC recommends disapproval of .the bulkhead because no need
is shown. The house and bluff are not endangered, the bluff is following
the natural process.
The Council suggests the gazebo be located in a more landward site
or on pilings~

Vote of Council: Ayes: All
Motion carried.
On a motion by Bruce Louckar seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application NO. 44-22-11 of Susan Tasker to construct a
house. The Council recommends disapproval because:
1~ The project is too close to the wetlands.
2. The project is too close to the beach.
3. The property is too small for a house, cesspools, etc.
4. The bulkhead' ~s too high.
5. The plan is not accurate. (As shown on the plan, at present
the retaining wall~weuld be in the water at high tide.
6. The CAC does not feel that bulkheads should be on the Sound.

notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
pro3ec~ will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other departmen~ or agency
which may also have an application pending for the same or similar
project.
A planting survey shall be submitted prior to final approval.

DESCRIPTION OF ACTION: Construct 100 1.f. of timber retaining wall
attached to return of adjacent wall to east a~ a point 18' from
corner. 16 t.f. angled return will be built on west side. Approx.
500 c.y. of clean sand will be trucked in for backfill via Bailie
Beach Road. West and of wall will be in toe and eroded bluff which
must be regraded as it is now unstable. In addition, a 4' X 20'
section of steps will be replaced and/or repaired as appropriate and
4' X 10 +/- retractable stairway added for access to beach. Project
is an emergency as the 12/11/92 storm caused severe erosion which is
threatening a concrete block structure which supports stairs.

t. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that

should the project be implemented as planned.
