Southold Town Board of Appeals February ~, 1959 A regular meeting of the $outhold Town Board of Appeals was held at the T~n Clerk's Office, Southold, New York, on Wednesday, February ~, 19%9 at ?530 P.M. There were present: Messrs. Robert W. Gillipie, Chairman, Robert Bergen and Charles Gregonis, Jr. Absent: Mr. Herbert Rosenberg and Mr. Serge Doyen, Jr. Also present: Hr. Howard M. Terry, Building Inspector. PUR~IC KRARING~ Appeal No. 135, upon application of Eva ~. Main, 100 Circle Drive, Pla~dome Manor, Long Island, New xork, for a variance in accordance with the Zoning Ordinance, ArtiCle IV, Section ~00, Subsection 1, for permit construct duplex dwellings on Lots 10, 11 and 12 located at east side GoldinLane, Southold, New York. Chairman opened the hearing by reading application for the variance, notice of disapproval issued te applicant by the Building Inspector, and leg~ notice of hearing with affi- davit attesting to its publication in the official newspaper. Mr. Terryshowed a sketch of the property and described CHAIRMAN: Is there anyone present who wishes to speak for this application? Southold Town Board of Appeals -2- l~ebruary ~, 1959 ~r. Gordon Ahlers, Ja~esport, New York, spoke for the appli- cant. Mr. Ahlers l~oduced a cardboard model of the property and proposed location of the structures, and stated they would like to construct four (~) units. He indicated the side yard -~d rear yard requirements have been complied with and then explained that the average setback on ~oundview Avenue is 26 ft. and on Goldin Lane 17 ft. Discussion was held relative to the previous appeals made by Mrs. Main on lots 11 ~-d combined lots iS an~ 1~. OHAIRNAN: The buildings you would like to move, how are they to be located with relation to ~oldin Lane? MR. Am.~n~S: Those cottages we will move back ~5 or 50 ft. from the street line. MR. BERGEN: What have you allowed for parking area for cars? MR. AHLERS: There will be space provided next to the porch on each side, and in the back of the duplexes, there will be room for that. As ! mentioned before the hearing began, there will be a centr~l water system to supply all units, and there will be two cesspools for each ~tt. The density allowed by the Code is for 20 fRm~lies and we are only putting in 10 f~mtlies. As far as enhancing the area, this cluster of cottages will ~mprove the area greatly. CNAIRMAN: How~any lots was this in before? MR. ~S: Seven lots. CHAIRMAN: Mr. Terry, is this a filed map? MR. T~RY: This is a filed subdivision. CHAIRMAN: It is proposed to place six structures in the final arrangement of the buildings on seven lots, is that correct? MR. ~wr.RRS: Yes. MR. MAIN: There will be lawn around the entire area, and driveways for parking in the rear. There w~uld be no necessity for parking on the read - Goldin Lane. There was considerable diecussion relative to placing of the cottages which are to be moved to the rear of the property and it was decided they should be placed at the minimum distance allowable by the Ordinance. The Chairman drafted the following proposed resolution to enable everyone present to have a clear picture of the appeal: Southold Town Board of Appeals -3- February ~, 19%9 The proposed structures be numbered cons.ecutivel, y from north to south 1,2, 3, ~, 5, --d 6.. ~,mbers 1, 2., %, and 6 are duplexes with outside d~mensions of 7% ft' x 20 ft. % in. Structure No. 3 is 2~ x 38 a-4 Structure No. % is 21 x 3~. Duplex No. 1 to be located parallel to $oundview Aveuue at a distance of not less th~n 26 ft. conforming with the prevailing adjacent setbacks on Soundview Avenue. The easterly line of this Duplex to be no closer at any point to the easterly line of the property than 10 ft. 6 in. The westerly line on Goldin Lane to be no closer than 17 ft.; Duplex No. 2 - the northerly line of Duplex No. 2 to be at no point closer than 20 ft. to Duplex No. 1. The westerly line of Duplex No. 2 facing on Goldln Lane to be parallel to Goldin La-~e at a distance of 17 ft; Building No. 3 to be located parallel to Goldin Lane at a distance no closer than 1% ft. to the easterly property line. Build~-_~ Ne. 3 to be equally distant from the southerly line of Duplex No. 2 and the northerly line of Duplex No. ~; Duplex No. ~ to be located parallel to Goldin Lane at a distance of 17 ft. and ~% ft. fr~a the southerly line of Duplex No. 2; Building No. %, which is 21 x 3~, to be located parallel to Golden Lane equally distant between the southerly line of Duplex No. ~ and the northerly line of Duplex No.6, and at a distance no closer than 1% ft..from the easterly line of the property; Duplex No. 6 to be~oc~ted ~% ft. south of Duplex No. ~, parallel to Goldin Lane at a distance no closer than 17 ft. No part of the southerly line of Duplex No. 6 to be closer than 17 ft. from Route 27. CHAIRMAN: I~ tb~t what you people are requesting? MR. Am.~: Yes. CHAIRMAN: Is there anyone present who wishes to speak against this application? MR. DANIEL OHARNEWS, You~gs Avenue, S~uthold, N.Y.,~ You have already granted themper~ission on those two buildings on the ends. You have given them a little leeway already. I think that is enough. CHAIRMAN: When you impose zoning restrictions on a whole area some things won't fit. This situation, as I ,mderst~d it now after tonight - this was a filed map of the Town, which is a recognized map in the Zoning Ordinance. They become a part of it. Zome lots are -nder-size, however the man owned them 20 or 30 years am~ they are in the "B" Business District and he has certain rights which exist a,~_. occasionally you have to give a variance. MR. CHARNEWS~ The point is, if he came in in the beginning would you have given him the whole four duplexes then - a variance of ordinance for the whole four in the beginning? CHAIRMAN: Yes, I think we w~uld have. Southold Town Board of Appeals -~- February ~, 19%9 MR. CHARNEWS= This is Just like having ten houses on seven lots. CHAIRMAN: ~t is not the same, there are proposed to be four duplexes, which are similar te ranch-type houses. The Chairaaa aaswered several of ~r. Charnews' questiens relative to sewage, and parking facilities. ~r. Charnews explained that he o~ned beach-front property 100 ft. east of a piece of beach-front property owned by ~r. Main and he was concerned that the additional structures, bringing more people into the area, would cause ~ overflow on to his beach. Mr. Oharnews went on to say that he did not feel the propesed structures would be an asset to the neighborhood. MR. MAIN= Mr. Oharnews, we believe these buildings will the value ~f all property in the vicinity. Yours =4 ~ine. MR. CHARNEWS= I suppose you are going to have an office in ene of the end duplexes. MR. ~AIN= I have ~Jready made plans for the renting ef the duplexes. They will be rent~n~ them for the season or half season only. As a matter of fact Mrs. Main and I intend to live in one of the small cottages in the rear during the mmer. Mr. Charnews stated that these hearings seemed to. be at quite a convenient ti~e when no one who owned property in the area (~osLly sum~er residents) co,Id attend. The Ohairman~allyexpXained to Mr. Oharnews the ~rocedure that is followed when setting up a F~blic hearing. MR.CHARN~S= It does not seem right to ~e, that as I u~derstand it ze~ is uude~ state Jurisdiction. ! don't think the State should be able to take the power away fro~ the Town officials. CHAIRMAN= Of all the hearings I have conducted, before and after zoning went into effect, this is the first ti~e ! have heard mention of ~tate controlled zo-~-~. (The Chairman went on to clarify this point in Mr. Charnews, mind.) C~A~= As to the legality of this request, it seems quite reasonable to ~e. I weuld defend anything you would l~Fe to do as well as this because ~ believe this is leg~. Hearing Closed. The aforementioned resolution was offered by Mr. Bergen, sedonded by Mr. Gregonis and ~,~,imeusly carried. Vote of the Board= Ayes- Mr. Gillispie, Mr. Bergen, Mr. Gregonis. Southold To~n Board of Appeals -%- February ~, 1959 Minutes of January 29, 1959 were read. On motion of Mr. Gregonis, seconded by Mr. Bergen and carried, the minutes were approved as submitted.
