NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Soufhold Town Board, as lead agency for
the action described below, has determined that the project, which
is unlisted will nov have a significant effect on the environmenz.
DESCRIPTION OF ACTION
Application of Helen B. Case for a wetland permit. Permission
is requested for approval of construction of bulkhead consisting of
broken concreze on West Creek off south side of New Suffolk Avenue,
Cutchogue, New York.
The pro3ect has been determined not To have a significant effect
on the environment for the following reasons:
An environmental assessmen~ has been submitted which indicated
that no significant adverse effect to the environmen~ are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board
Town Trustees and Southold Town Conservation Advisory
that this projec~ would not have a significant effecz
of Southold
Council indicating
to the environment.
.. Because there has been no response in the allotted time from the
New York State Department of Environmental ConserVation and the Southold
Town Building Department, it is assumed that there are no objections nor
comments from those agencies.

D. A detailed statement of the rehabilitation and prcposea condition of tr~e premises after the'
work ~s completed must be given, including a survey if reauired.
E. If ~ermit is being sought for a more sizeable excavation ?hah the construction of o private
single dock or jetty, then this application must be accompaniea by a survey and topographical mop
certified by a registered land survey ar Professional Engineer. The horizontal control of surYey
shall be based upon an approval local coordinate system. The vertical control far elevation and sound-
ings shall be based upon United States Coast aha Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the appllcatiorn describing cnw known prior operations :onducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or susoended by o governmental agency. _
G. A filing fee of $2,5.00 shall accompany the a~Dlication. This filing fee includes one inspection.

The following action was taken by the Board of Trustees at its
regular meeting held on July 26, 1990:
RESOLVED that the Trustees approve the request for a Grandfather
Permit for existing rock and concrete breakwater on property
located on the southerly side of of New Suffolk Avenue in
Cutchogue, NY at the above-referenced tax map number.
Prior to placement of any additional ~oncrete or rocks on said
property, please notify the Bay Constable and the NYS
Department of Environmental Conservation.
