The following action was taken at the Southold Town Board of Trustees regular meeting
held on Wednesday, December 12, 2007:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a
Transfer of Permit ~4284 from George Case to Jaime Santiago, as issued on February
24, 1994.
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE
the Amendment to Permit #4284 to repair the beach stairs with the addition of two
landings no larger than 32 square feet, and to renovate the existing beach house, and
as depicted on the site plan prepared by Michael W. Behringer, Architect, last dated
October 23, 2007, received on November 16, 2007.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Jaime A. Santiago requests a Wetland Permit to repair an access staircase and renovate an
existing wood frame structure. Located: 3745 Nassau Point Road, Cutchogue. SCTM#111-9-4.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit".

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

affect the achievement of the LWRP policy standards and conditions contained in the consistency

As the new owners of the properly listed above, I am requesting that permit
No. 4284 Issued February 25, 1994 to George Case, be transferred to Jaime A.
Santiago and Nancy Santiago as the new owners of this properly.
In addition I am requesting permission to rebuild the existing dune staircase
leading to the beach located on the south side of our properly. The proposed
staircase would include a new landing for safely. We would also want to renovate
an existing wood frame structure by replacing the roof, siding and stairs leading
to the beach from the structure. The stairs are damaged and need handrails for
safely. All of these changes are detailed on the enclosed Architectural blue
prints. All specs for this proposed renovation are listed on the prints for your
review. I understand that nothing additional that is not already authorized on the
existing permit~ 4284 will be added or allowed. I have included a number of
photographs of the structures involved in the repair.

The following action was taken by the Board of Town Trustees during
its regular meeting held on February 24, 1994 regarding the above
matter:
WHEREAS, Eh-Consultants on behalf of George S. Case, Jr. applied to
the Southotd Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated December
6, 1993 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on Thursday, February 24, 1994 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area~ and,
WHEREAS, the Board has considered all the testimony and docmuentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that the Board of Trustees approves the application of
Eh-Consultants on behalf of GEORGE S. CASE, JR. request a permit to
construct 198 1.f. of timber retaining wall extending from landward
end of return to south, to corner of retaining wall to north. Wall
will run generally along toe of bluff and approx. 50' landward of
AHW. Approx. 300 c.y. of clean sand will be brought in via ROW
&00' north off Nassau Point Road, rebuild an existing 4' X 50'
stairway from crest of bluff to beach and 4' X 4' wood platform at
crest of bluff will also be replaced and plantings on bluff. The
Beach House will be removed during and construction and not replaced.
Located 3745 Nassau Point Road, Cutchogue.
Permit will expire two years from the date it is signed. Two
inspections are required and the Trustees are to be notified upon
completion of said project.

PROJECT DESCRIPTION
Construct 198 1.f~ of timber retaining wall extending
from landward end of return to south, to corner of
retaining wall to north. Wall will run generally along
toe of bluff and approximately 50' landward of ~2{W.
Approximately 300 c.y. of clean sand will be brought in
via right-of-way 400' north off Nassau Point Road for
backfill.
Rebuild an existing 4' X 50~' stairway from crest of
bluff to beach. A 4' X 4' wood platform at crest of
bluff will also be replaced.

Dear Mrs. Peterson:
The above-referenced permit to construct a retaining wall was
issued on April 19, 1994.
If you will notice from the photographs submitted with that
application, a beach house is present which is lying on its side
against the bluff. The timber foundation on which it stood remains
present and functional. We request per-~ission to simply pick up
the beach house, replace it and secure it to the existing
foundation. No new construction will occur.
The beach house is not and will not be connected to any utilities.
Due to the minor scope of this request, I am unsure whether a
permit is actually needed, but wish to file this inquiry to assure
compliance.
By copy of this letter I am requesting the Southold Trustees to
take similar action.
