IN THE MATTER OF
MICHAEL CARLUCCI
PUBLIC HEARING
8: 28 P.M.
IN THE MATTER OF THE APPLICATION OF MICHAEL CARLUCCI TO
MAINTENANCE DREDGE AN AREA 45' x 40 ' TO A DEPTH OF 3 '
BELOW MLW DIRECTLY INFRONT OF HIS RESIDENCE. AREA WAS
PREVIOUSLY DREDGED IN 1960. MATERIAL WILL BE REMOVED AND
DEPOSITED UPLAND AS FILL ON CARLUCCI AND BALDWIN PROPERTIES
USING A CRANE. PROPERTY IS LOCATED AT 8A ISLAND VIEW LANE,
GREENPORT.
PRESIDENT SMITH: We have a few letters in the file which I
would like to have read and entered into the minutes of this
public hearing. President Smith requested that the Secretary
read the correspondence in the 'file from Mrs 'Rita -Jones and
from the Baymen' s Association:
Dear Mr. Smith: I am opposed to the issuing a permit to Michael
Carlucci to dredge in front of his property because of the
environmental impact it could have on my property and
conservation. My property is situated to the west of Carlucci and
Baldwin properties. Since both Carlucci and Baldwin properties
are bulkheaded, it would be to their advantage to have the
dredging and mooring of boats in the creek. My property is not
bulkheaded, and is in a low area. The shifting of sand and mud
could have a devastating effect on my property. I could end up
with more water, no water or no change at all. This project
is of no value to me-and the surrounding area. I am not willing
to risk the effects that this dredging of a hole, (to keep a
boat off the mud) could have to me. This area was dredged in
1960 because it was originally not on the water. The result
of this dredging gave it water front. I have contacted the
Department of Army Engineers in Manhattan and spoke to Mr. Alex
Lechlich and he informed me that a permit was granted to
Mr. Carlucci in October. There was no field study made of
this area and the permit was granted on a basis of comments
and photographs. This is not sufficient evidence for me.
Before this permit is approved, I would like the Town of
Southold to do a field study of this project and to take
everyone surrounding into consideration. I want Mr. Carlucci
and the Town of Southold to give me a guarantee that there will be
no change to my property as a result of this project. Otherwise,
I am holding Mr. Carlucci and the Town of 'Southold responsible for
the effects it could have to me. Very truly yours, Rita M. Jones,

TRUSTEE ELECT ELLEN LARSEN: This lady, Mrs. Jones, :if she is an
adjacent owner when Mr. Carlucci submitted his application to the
Army Corps of Engineers she as the adjacent property owner would
have received notification of this application. So it surprises
me that she was not aware that there was an application with the
Army Corps.
RITA JONES: I 'm Rita Jones and I was notified by the Army Corps
and all they did was send me back a letter saying receipt acknowledged.
TRUSTEE:, SMITH: We have another letter of objection from the
Baymen' s Association that I would like to have read.
ILENE PFIFFERLING: From the Southold Town Baymen' s Association
Dear Sir: This letter is in reference to public notice
number 12119-85-064-L2, regarding proposed dredging by Michael
Carlucci in Conklin Point Creek of the Town of Southold, Suffolk
County, New ,York. We oppose the dredging of this 40 ft. by 45 '
area for several reasons. Approximately 7 'feet by 45. eet of the
proposed dredge area is a potentially active intertidal zone.
This area, although recently disturbed by bulkhead construction,
has a few striated mussels growing in it and shows good potential
for the growth of Spartina Alterniflora. The depth of both the
creek and it' s entrance is only 6 inches at low water, making
navigation difficult and hazardous, if not ',impossi:ble, much of the
time. The dredging would create a 3 ft. hole in the back of the
creek, where water will tend to stagnate. One neighbor,
adjacent to the east, Ms. Stemmler, whose property fronts 40 ft. of
the proposed dredging, is opposed to the project, because the
additional depth of the water immediately in front of her bank
could and probably would create bank erosion. She is not interested
in involving herself with the cost of aesthetic blight of bulkheading
her property. Very truly yours, Steve Latslon, Secretary and
Peter Wenczel, President of the Baymen' s Association.
TRUSTEE SMITH: Thank you. Are there any ojther comments?
MR. GEORGE BALDWIN: I am Mr. Carlucc`s neighbor to the west. I
would like to address Mrs. Jones problem. She lives four or
five-hundred feet west of the proposed project. I feel Mrs . Jones
has a problem with understanding the tidal action and the fact,
actually that water seeks it ' s own level. S feel that it has no
potential to have any drift of mud or silt or anything else from
that and I don't feel that it will affect her at all.
I am, I stand for the project and I entend to be part of the
project with Mr. Carlucci.
MR. CARLUCCI: As I explained before, back in 1960 that area was
dredged approximately 200 ft. by 40 ft. wide or so.:. It was on
privately owned land, as it is now. Duringthe time of the last
25 years we have had movement which has filled in. At that time
it was dredged about 4 to 6 : ft. ' deep at low water. I think history
has shown that over the last 25 years there'' has-not been any significant
affect on the entire creek. The area that I'', am proposing to dredge
-3-
Board of Trustees - Public Hearing in the matter of Michael Carlucci.
is about 4/1000' of the entire creek which is approximately 10 or 11
acres.cHowever, I 'm dredging approximately 40 ft. by 40 ft. In
reference tothe Baymen' s letter - any type of mussel activity
that they are talking-of- _'- there has been it`.s .a nominal amount.
In reference to Mrs. Stemmler - I can't agree with her the
dredging is limited to 5 to 10 ft. from the shoreline. I 'm
reducing it to prevent any further erosion, which s,natural
alongi.the` shoreline':. ..;.
TRUSTEE SMITH: You say 5 to 10 ft. is it?
MR. CARLUCCI : Right - from the shore. What it is. . . is going out
a mere 5 ft. to a point the creek opens up.
TRUSTEE SMITH: It' s owned by a.-. . .
j MR. CARLUCCI; Its owned by three people. Mulholland, Casamisina
and Lordi.
TRUSTEE SMITH: I think there is a letter in the file?
ILENE PFIFFERLING: There is a letter from Mulholland..giving
authorization.
MRS. JONES: I feel we should dredge and maintain the mouth of
the creek to make navigation better in the creek, not just the
hole-where Mr. Carlucci lives. It is not an even flow of water
going in. That' s why they need a field study to see what our place
really looks like.
MR. CARLUCCI: You brought up .a good point. Over the last ten
years the inlet was originally at the point. At that time we had
high and low water. The creek never really emptied out or was
completely full. It was narrow going in and out. The original
inlet was at the point.
TRUSTEE KUJAWSKI: Wasn't it clogged up with wrecked automobiles?
MR. CARLUCCI: I ' ll get to that. The original inlet was at the
point. What happened, the Sage Property, over the last ten
years, they lost over 100 ft. of shore of beach front. He
tried to prevent this by putting in old wrecked automobiles.
When the old inlet closed up the Sage' s broke through. Now
what we have is a full tidal flushing action. We are getting
cleaner action whereas ten years ago the creek was more stagnant.
Now what ever level the bay is the creek is. At very low tide
we will have mud flats in the creek, if it is high tide we will
have wave action in the creek. If we have wind out of the
Southwest it will be blowing right through the inlet and will
be exceptionally high tide. In reference to the dredging to
a depth of 4 ft. , water will seek it' s own level.
' -4-
Board of Trustees - Public Hearing in the matter of Michael Carlucci.
TRUSTEE SMITH: Thank you.
MRS. JONES: Now, next week our neighbor down the other end is
going to ask for a permit of dig a hole and I 'm going to ask
for a permit. I feel if we maintain the opening of the creek. . .
If we all got together. Why didn't you speak to me about this
before?
MR. CARLUCCI: The creek inlet now is privately owned property.
Any activity on there will have to come under the Commiission
of State to see what they want to do with it.
TRUSTEE KUJAWSKI: We have been down there several times, and
have made several inspections.
MRS. JONES: That is also a conservation area.
TRUSTEE KUJAWSKI: It would be nice if everyone got together
because if it is privately owned land it doesn't fall under the
same treatment as public land does. If it was public bottom, it
probably wouldn' t be done at all. Is there a property owners
association down there?
MRS. JONES: Yes.
TRUSTEE KUJAWSKL• Wouldn' t this be addressed at a meeting? Call
a meeting:
TRUSTEE SMITH: .Are there any other comments for or against this
application? Hearing no further comments President Smith closed
the hearing at 8: 40 P.M. .

Review and 6NYCRR Part 617, Section 717. 10 and Chapter 44 of the
Code of the Town of Southold, notice is hereby given that the
Southold Town Trustees, as lead agency for the action described
below, has determined that the project will not have a . significant
effect on the environment.
TYPE OF ACTION: Unlisted

NEGATIVE DECLARATION
NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
November 27, 1985
APPLICATION NO. 242
NAME: Michael Carlucci
This notice is issued pursuant to .the provisions of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 717. 10 and Chapter 44 of the
Code of the Town of Southold, notice is hereby given that the
Southold Town Trustees, as lead agency for the action described
below, has determined that the project will not have a significant
effect on the environment.
TYPE OF, ACTION: Unlisted
DESCRIPTION OF ACTION: To maintenance dredge an area 45 ' x 40 ' to
a depth of 3 ' below low, water directly in front of his residence.
To fill with approximately 162 cu. yds. to be placed upland on
property of Carlucci and Baldwin.
LOCATION OF PROJECT: 8A Island View Lane, Greenport, New York.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment has been submitted in the
long form indicating that no adverse effect to the
' environment is likely to occur should the project be
implemented as planned.
2. The Conservation Advisory Council recommended that a
retaining wall or bulkhead be constructed so that the
spoil does not wash into the creek.
3. Because there has been no response in the allotted time from
the New York State Department of Environmental Conservation
and the Southold Town Building Dept. it is assumed that
there are no objections or comments from, .those agencies.

Re: Michael Carlucci
Dear Henry:
In examining all of. the maps and other information which you sent me
relative to-the application of Michael.Carlucci, it would appear that the
area in question is landward of the ordinary high watermark of Conklin
Point Creek and, therefore, it would be my opinion that the land in
question is privately owned.
Yours very truly,

BOARD OF TOWN TRUSTEES
IN THE MATTER OF
MICHAEL CARLUCCI
PUBLIC HEARING
8: 28 P.M.
IN THE,MATTER OF THE APPLICATION OF MICHAEL CARLUCCI TO
MAINTENANCE DREDGE AN AREA 45 ' x 40' TO A DEPTH OF 3 '
BELOW MLW DIRECTLY IN FRONT OF HIS RESIDENCE. AREA WAS
PREVIOUSLY DREDGED IN 1960. MATERIAL WILL BE REMOVED AND
DEPOSITED UPLAND AS FILL ON CARLUCCI AND BALDWIN-PROPERTIES
USING A CRANE. PROPERTY IS LOCATED AT 8A ISLAND VIEW LANE,
GREENPORT.
PRESIDENT SMITH: We have a few letters in the file which I
would like to have read and entered into the minutes of this
public hearing. President Smith requested that the Secretary
read the correspondence in the file from Mrs. Rita Jones and
from the Baymen' s Association:
I could end up
with more water, no water or no change at all . This project
is of no value to me and the surrounding area. I am not willing
to risk theeffects that this dredging of a hole, (to keep a
boat off the mud) could have to me. This area was dredged in
1960 because it was originally not on the water. The result'
of this dredging gave it water front. I have contacted the
Department of Army Engineers in Manhattan and spoke- to Mr. Alex
Lechlich and he informed me that a permit was granted to
Mr. Carlucci in October. There was no field study made of
this area and the permit was granted on a basis of comments
and photographs. This is not !sufficient evidence for me.
Before this permit is approved, I would like the Town of
Southold to do a field study of this project and to take
everyone surrounding into consideration. ' 'I want Mr. Carlucci
and the Town of Southold to give me a guarantee that there will be
no change to my property as a result of this project. Otherwise,
I am holding Mr. Carlucci and the Town of 'Southold responsible for
the effects it could have to me Very truly` yours, Rita M. Jones,

Board of Trustees - Public Hearing in the matter of Michael carlu "
TRUSTEE ELECT ELLEN LARSEN: This lady, Mrs. Jones, if she is an
adjacent owner when Mr. Carlucci submitted his application to the
Army Corps of Engineers she as the adjacent property owner would
have received notification of this application. So it surprises
me that she was not aware that there was an application with the
Army Corps:,
RITA JONES: I'm Rita Jones and I was notified by the Army Corps
and all they did was send me back: a letter saying receipt acknowledged.
TRUSTEE SMITH: We have another letter of objection from the
Baymen' s Association that I would like to have read.
ILENE PFIFFERLING: From the Southold Town Baymen's Association-
Dear Sir: This letter is in reference. to public notice
number 12119-85-064-L2 , regarding proposed dredging by Michael
Carlucci in Conklin Point Creek of the Town of Southold, Suffolk
County, New York. We oppose the dredging of this 40 ft. by 45 '
area for several reasons. Approximately 7 feet by 45 feet of the
proposed dredge area is a potentially active intertidal zone.
This area, although recently disturbed by bulkhead construction,
has a few striated mussels growing in it and shows good potential
for the growth of Spartina Alterniflora. The depth of both the
creek and it's entrance is only 6 inches at low water, making
navigation difficult and hazardous, if not impossible, much of the
Very truly yours, Steve Latson, Secretary and
Peter Wenczel, President of the Baymen' s Association.
TRUSTEE SMITH: Thank you. Are there any other comments?
MR. GEORGE BALDWIN: I am Mr. Carlucc ' s neighbor to the west. I
would like to address Mrs. Jone ' s problem. She lives four or
five-hundred feet west of the proposed project. 'I feel Mrs. Jones
has a problem with understanding the tidal action and the fact,
actually that water seeks it ' s own level. I feel that it has no
potential to have any drift of mud or silt or anything else from
that distance and I don't feel that it will affect her at all.
I am, I stand for the project and I entend to be part of the
project with Mr. Carlucci.
MR. CARLUCCI: As I explained before, back in 1960 that area was
dredged approximately 200 ft. by 40 ft. wide or so. It was on
privately owned land, as it is now. During the tine of the last
25 years we have had movement which has filled in. At that time
it was dredged about 4 to 6 ft. deep at low wat I think history
has shown that over the last 25 ,years there has#en Vsignificant
affect on the entire creek. The area that I am proposing to dredge

4,,,,Dear Sir,
This letter is in reference to public notice numb
12119-85-064-L2, regarding proposed dredging by Michael
Carluoci in Conklin Point Creek of the Town of Southold,
Saffolk County, New 'York. '90 Oppase the dredging of this
40 foot by 45 foot area for several reasons.
Approximately ?feet by 45 feet of the proposed dredge
area is a potentially active intertidal ,aone. This area,
although recently disturbed by bulkhead 'oonstruetion,, 11
a few striated' musseis growing in it and shows good poten-
,t al for the growth of Spartirna _Uterniflora,
The depth of both the creek and iris entrance is only
6 inches at loin water 3 Pinking navigation difficult and
.hazardous, if r1ot impossible, much of the time. The dredging;
w-luld create a 3 foot deep hole is the back of the creek,
where water will tend to stagnate.
One neighbor, adlacent to the ;east, _Ms. Stemmler, whose
property fronts 40 feet of the proposed dredging is opposed.
to the Project . because the additional depth o ' the water
immediately in front of her bank could and probably would
_create bank erosion. „She is not interested, involving her-
self with the cost or aesthetic blight of bulkheadi.ng her

General Information (Read Carefully)
/y°iG.1e%TLHrtZl9f'Lt't+r. r;z
in ccmpTeting the form the reviewer should be guided by the question: Have my decisions and determinations
been reasonable? The reviewer' is not expected to be an expert environmental analyst.
- Identifying that an affect will be potentially large_ (column 2) does not mean that it is also necessarily
sienificant. Any large effect must be evaluated in .A.RT 3 to determine, significance. By.:ideatifying an
effect in column ? simply asks] that it be leaked at furtner.-
The Exaroles provided are to assist the reviewer by showing types a-• effects. and. wherever possible the thresholc
of magnituee that would trigger'a 'response in cola-.n 2. The examples are generally applicable throughout the
State and for most situations. But, 'or any:scecific project or site other examples and/or lower thresholds
may be more appropriate for a Potential Large Impact rating.
- Each project, on each site, in each 7oca7ity, will vary. Therefore, the examples have been offered as guidance.
They do not constitute an exhaustive list of imoacts and thresholds:to answer each question.
The number of examples per question does not indicate the importance of each question.
INSTRUCTIONS (Read Carefully)
a. Answer each of the 1S questions in PART 2. Answer Yes if there will be any affect.
b. Maybe answers should be considered as Yes answers.
a. If answering Yes to a ouestion then check the aporcbriate cox (column 1 or 2) to indicate the potential
size of the impact. . If impact threshold equals or exceeds any example provided, check column 2. If
impact will occur butthreshold is lower than exar..vie, check column s_
d. If reviewer has doubt about the size of the impact 'll?o .consider the impact as potentially large and
proceed to PART 3. - -
e. If is potentially large impact or effect can be reduced by a change in the project to a less than large
magnitude, place a Yes in column 3. A No response indicates that such a reduction is not possible.
