Dear Mr. Caducci:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., July 22, 2009:
WHEREAS, MICHAEL CARLUCCI applied to the Southold Town Trustees for an
Amendment to Wetland Permit #1788 under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated June 30, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
BE IT FURTHER
RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to
Wetland Permit #1788 to replace in-place the existing 40' timber bulkhead and two
existing 8' and 12' returns, and backfill with up to 12 cy. of clean upland fill. Include
existing piling at north end of floating dock and replace by steel pipe or timber and to
include the existing floating dock and 2'X 7' ramp, with the condition of a 10' non-turf
buffer, and as depicted on the plan prepared by Michael Caducci dated June 21, 2009.

existing 40' timber bulkhead and two existing 8' and 12' returns, and backfill with up to 12 cy.
of clean upland fill. Include existing piling at north end of floating dock and replace by steel
pipe or timber and to include the existing floating dock and 2'X 7' ramp. Located: 865 Island

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided that the following recommendations to
further the below listed policies are implemented.
5.3 Protect and enhance quality of coastal waters.
Protect water quality based on an evaluation of physical factors (pH, dissolved
oxygen, dissolved solids, nutrients, odor, color and turbidity), health factors
(pathogens, chemical contaminants, and toxicity), and aesthetic factors (oils,
floatables, refuse, and suspended solids).
To further the above policy, it is recommended that the Board minimize the use of CCA treated
materials in the bulkhead and dock design and require turbidity control during construction
operations.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby
development are avoided:
Maintain buffers to achieve a high filtration eff'~ciency of surface runoff.
Avoid permanent or unnecessary disturbance within buffer areas.
Maintain existing indigenous vegetation within buffer areas.
If the action is approved it is recommended that a perpetual landscaped buffer be required
landward from the bulkhead.
LANDSCAPED BUFFER -- a land area of a certain len.qth and width which is planted with
indigenous, drought tolerant, vegetation similar to that found within the immediate proximity of
the parcel. Veqetation shall be installed in sufficient densities to achieve ninety-five (95)
percent ground cover within two years of installation. Survival of planted vegetation shall be
(ninety) 90 percent for a period of three years. Maintenance activities within the buffer are
limited to removinq vegetation which are hazardous to life and property, trimming tree limbs up
to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing
a four foot (4') wide access path constructed of pervious material for access to the water-body.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Please find enclosed my application to amend bulkhead and
floating dock permit number 1788, issued on January 17, 1984. The
permit authorized the replacement of the original bulkhead that
was constructed in 1961, and installation of a floating dock. The
purpose of this amendment is to replace the existing bulkhead and
returns, in place, with treated timber and vinyl sheathing; and to
note minor changes to my original floating dock permit plan. It is
anticipated that the bulkhead work will commence during the open
period for maintenance dredging (Trustees Permit # 6299), on or
about October 2009 through February 2010.
The existing bulkhead is rotting at and below the water line,
sinking and bowing out. The bulkhead plans submitted are
essentially the same as those submitted for the original permit,
except the pilings will rise four feet above the top of the
bulkhead. This change will allow my boat to rest along the pilings
at high tide. High tide is approximately 18 inches below the
bulkhead, and at times at or above the bulkhead. Being in a iow
area on the north end of the creek, this change will also protect
the property from large floating objects coming ashore during
storms. A boat landed on the property after one storm.
Request the original floating dock permit plan be amended to
indicate an existing piling at the north end of the dock; and that
the existing dock ramp dimensions are 7'L x 2'W, instead of 5'L x
4'W.

In reference to the attached letters dated August 12, 1983
and August 11, 1983 from your office and the Town Building
Inspector respectively, I disagree with the Town Building
Inspector's findings.
The Building Inspector claims my bulkhead and property 1/~e~~
are one and the same. This is i~'L~t~Ex~i~i~ of
my application for a floating ~Sck~ permi~'~s that my prop-
erty line extends approximately 12 to 14 inch~s seaward beyond
my bulkhead. ~
The alleged "beach" area the Building Inspector refers to is
soft mud which does not support any type of plant life and is
too soft to walk on.
The Building Inspector further alleges that the "beach" area
is wetland property at low tide. This is also incorreCt.
The Southold Town Code (STC), Chapter 97, entitled Wetlands,
defines wetlands and the requirements for a wetlands permit.
According to STC, Chapter 97, Section 13, Wetlands A, wetlands
are specifically defined as: "all lands generally covered or
intermittently covered by tidal waters and upon which salt --~3~'~'
meadow grass (Spartlna Patens) and/or cord grass (Spart~na
Alteniflora) grows or is capable of being grown. Neither of
these two types of grass are present on my property or on
the low fide "beach" area located in front of my bulkhead.
According to the US Army Corps of Engineers Pamphlet entitled
"Wetland Plants of the Eastern United States", SPartina

Alteniflora is located in saline shorelines and marshes,
and Spartina Patens is located in salt and brackish coastal
marshes. Spartina Alteniflora, and in particular, Spartina
Patens, are located in a zone from the high water mark to the
level of spring tides. My bulkhead is the high and spring
tide water mark. At regular high tides, the water depth at
the foot of my bulkhead is over two and one-half feet.
Sections of the Pamphlet pertaining to the two grasses are
attached.
The area in front of my property does not contain Spartina
Patens or Spartina Alteniflora grasses, and is not capable
of sustaining these two grasses, as the attached Pamphlet
sections attest to. The "beach" area therefore is not wet-
lands as defined in STC Chapter 97, Section 13, Wetlands A.
Further, STC Chapter 97, Section 20, specifically states
that ... "no person shall conduct operations on any wetlands
in the Town of Southold unless he shall first obtain a written
permit ..." Since this area is not wetlands, a permit is
not required under STC Chapter 97.

SALTMEADOW CORDGRASS
Spartina patens
Located in salt and brackish coastal marshes through-
out the Division. Also known as Saltmeadow Hay.
A perennial grass with smooth stems; 15-80 cm long.
Spring stems arising from the mat of last years vegetation.
Two to 5 (normally 4) new, green leaves in spring; 0.5 to
2.0 mm wide tapering to slender tips. One tO 4 spikes on
the flowering stems; purplish; 1.0 to 6.0 cm long.
Often fo~d in dense stands in the zone from mean high
water to the level of spring tides (shoreward of S. alter-
niflora). Landward extent often indicates the beginning of
the transition zone.
Important, but provides
less detritus than S.
alterniflora since it is
flooded less often. Im-
portant as food to black
ducks, geese and seaside
and sharptailed sparrows;
also used as food by
other ducks, shore and

SALTMARSH CORDGRASS
Spartina alterniflora
Located in saline shores and marshes along the coast
throughout the Division. Also known as Saltwater and Smooth
Cordgrass.
Stems are 0.1 to 2.5 m high; arising from a long, in-
terconnected rooL system. Leaves are flat when fresh and
curl as they dry; present to the top of the stem; 0.4 to
1.5 cm wide; smooth and leathery. Flower spikes 2 to 15 cm
long; flowers bloom from July through September.
Tall and short varieties are common. Pure stands cover
much of the east coasT. Seeds used as food by ducks, marsh,
shore and song birds;
rootstalk important to
geese and muskrat; plant
browsed on by deer;
major source of detritus
for the estuarine food-
web; important plant for
controlling erosion and
storm damage as well as
for purifying water.

ARTICLE II
Permits
§ 97-20. Permit required.
Notwithstanding any prior course of conduct or permismon
granted, no person shall conduct ooera~ions o~ a~3y w~.l~nd~ iH
the Town of Southold unless he shall first obtain a written permit
therefor issued by authority of the Town Board as hereinafter.
provided, and only while such permit remains in effect.
§ 97-21 Application.
A permit may be issued upon the written, verified application of
the person proposing to perform operations on wetlands. The
application shall be submitted to the Town Clerk in quadxuplicate.
Such application shall contain the following ~nformation:

whether applicant is the owner, lessee, licensee, con~rac~or.
e~c.). In all cases where the applicant is no~ the owner of
