The meeting was called to order by President Henry P. Smith at 7:00 P.M.. Present were: President Henry P. Smith Vice President John M. Bredemeyer, III Trustee Phillip J. Goubeaud Trustee Albert Krupski, Jr. Bay Constable Donald Dzenkowski Secretary Ilene Pfifferling Trustee Ellen M. Larsen (7:10 P~.) Trustee Smith advised that the date for the January field inspections will be held on January 22, 1987. Trustees are to depart from Town Hall at 12:00 P.M.. The date for the next regular meeting will be held on January 29, 1987 to commence at 7:00 P.M.. Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to APPROVE the minutes of the November 25, 1986 meeting as corrected: Communication No. 10 - the word marshes is to read water. Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED to RESCIND the following resolutions adopted on November 25, 1986 on page 23 as follows: D - SAL CAIOLA - WETLAND APPLICATION NO. 450 - TABLED Moved by Trustee Goubeaud seconded by Trustee Larsen it was RESOLVED to Deny the wetland application of Sal Caiola whereas there is no evidence of undermining of the lateral support of land in the vicinity based on land west of this property there has been no erosion. Trustee Larsen arrived at 7:10 P.M. Trustee Smith reported that he received a telephone call from Mr. Herbert L. Ortner, Attorney who represents Mr. & Mrs. Richard Prieto regarding a question of a right- of way on Corey Creek, Southold. Trustee Smith reiterated that in his opinion this property is a R.O.W. unless this can be proven differently and if any of the mooring renewals come up at that road ending that they~will be approved. Moved by Trustee Smith seconded by Trustee Larsen it was RESOLVED to APPROVE the renewal of mooring permits at the end of the R.O.W. on Corey Creek, Southold. Vote of Board: Ayes: Ail This resolution was declared duly 'adopted. Moved by Trustee Smith seconded by Trustee Larsen it was RESOLVED to APPROVE the FEBRUARY 1987 Mooring renewals. Vote of Board: Ayes: Ail This resolution was declared duly adopted. Trustee Smith gave the Trustees report for November 1986 ~as follows: Application Fees $75.00, Wetland Applications $700.00, Wetland Inspections $40.00, Docks and Bulkhead Fees $130.50 and Mooring Renewal Fees $45.00 for a total of $990.50. This has been turned over to the Supervisor to be placed in the General Fund. II. Public Notices: Trustee Smith advised that these notices are put on the Town Clerk's bulletin board if anyone wishes to review them. The President proceeded with agenda item number III. Communications. III. Communications: iA. Mr. John Wickham appeared before the Board to discuss repair work needed on his dike. The Board determined that an application is necessary for this work and requested Mr. Wickham to submit same to the Trustee office. Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED that Mr. John Wickham is to submit an application to the Board of Trustees for work to be done on the dike located on Grathwohl Road, New HENRY P. Dredge in front out to 15' Approximately 225 c.y. of spoil will be removed and placed behind the bulkhead as spoil. Bulkhead will correct to and be in line with recently constructed bulkhead to east. 10 year maintenance dredge is requested. The Council would like the applicant to re- submit or amend the application for only a floating dock and no bulkhead. The Council recommends the floating dock instead of the bulkhead to allw for the extensive col6nization of spartina which would'stabilize the land and reduce the nedd for any bulkhead. Indian Neck Road, Peconic. Vote of Council: Ayes: Ail MOtion carried. The application proposed construction of a sheet steel retaining wall along the toe of a bluff on Long Island Sound (the "Project") and the subdivision into two parcels of Applicant's parcel of land (the "Site") located in the Village of Greenport, Town of Southold, Suffolk Countyt New York. The combined Notice of Complete Application and Hearing was published in the Long Island Traveler-Watchman, a weekly newspaper of general circulation in the Town of Southold, on September 24, 1987, and in the Department's Environmental Notice Bulletin on September 23, 1987. Copies of the notices were sent by mail to the clerks and chief executive officers of the municipalities within whose boundaries the Site is located, and to others who expressed interest in the proposed Project. Statutes and Regulations The permit application was filed and processed pursuant to the State Administrative Procedure Act and Environmental Conservation Law ("ECL") Article 3, Title 3 (General Functions); Article 8 (State Environmental Quality Review; Article 25 (the "Tidal Wetlands Act"); Article 70 (Uniform Procedures); and pursuant to Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York ("6 NYCRR") Part 616 (State Environmental Quality Review Act "SEQRA"); Part 621 (Uniform Procedures); and Part 661; (Tidal Wetlands Land Use Regulations). The public hearing was held pursuant to Part 624 (Permit Hearing Procedures). State Environmental Quality Review Act ("SEQRA") On June 27, 1986, the Board of Trustees of the Town of Southold, as lead agency, issued a positive declaration pursuant to 6 NYCRR Part 617 for the proposed Project. Subsequent!y, on October 30, 1986, the Board reversed itself and issued a negative declaration for the proposed Project. Its determination was supported by the following reasons: An environmental assessment from has been submitted which indicated that there would be no adverse effect to the environment should the project be implemented as planned. -2- "2. Because there has been no response in the allotted time from the Southold Town Building Department and the New York State D.E.C. it is assumed that there are no objections or comments from those agencies." The Hearing At the request of Department Staff, an adjudicatory public hearing on the application convened before Administrative Law Judge ("ALJ") Samuel J. Kearing on October 29, 1987 in the Southold Town Hall~ 53095 Main Road~ Southold, New York. Applicant Sal Caiola was represented by Mr. Roy L. Haje, President, En-Consultants~ Inc., 1329 North Sea Road, Southampton, New York 11968. In support of the proposed Project, Applicant called three witnesses: Charles F. Vachris, P. E., a consulting engineer experienced in foundations and marine construction, Thomas Samuels, a marine contractor, and Mr. Haje, himself, a biologist. Department Staff was represented by Michael Greco, Esq., Assistant Regional Attorney, DEC Region I, Building 40, SUNY, Stony Brook, New York 11794. The Department called two witnesses, Mr. Jean L. Gilman~ the Department's Regional Flood Plain Coordinator, and resident expert in shoreline stabilization, and Mr. Frederick Mushacke, Marine Resources Specialist I, employed by the Department's Bureau of Marine Habitat Protection. At the conclusion of the hearingt the ALJ and representatives of the parties visited the Site. The record closed on December 5, 1987 upon receipt of the stenographic record of the hearing. Position of the Applicant Applicant contends that the permit should be granted to allow construction of a steel sheet piling wall across the entire Site to prevent the possibility of erosion to the bluff during unusual weather events such as hurricanes. Stone rip-rap to be installed along the toe of the wall would prevent erosion to the Stony beach and to adjoining properties. The project should be undertaken now as a safeguard against future erosion of the bluff. The proposed Project would have no undue adverse impact upon tidal wetlands and generally complies with the standards for issuance of permits in areas adjacent to tidal wetlands (6 NYCRR Part 661.10(c),the Applicant argued. Position of Department Staff Department staff objects to the construction of the sheet steel wall and backfilling behind such wall, as activities which may impair and alter the natural condition of tidal wetlands. -3- Department staff contends that the proposed Project is unnecessary; that there is no evidence of erosion along the toe of the bluff; that the proposed structure would not protect the bluff from damage under extreme conditions but would prevent material from the bluff from nourishing the beach and would be likelY to cause toe scour along the steel structure and erosion on neighboring parcels. The Project would be contrary to the spirit and intent of the Tidal Wetlands Act and 6 NYCRR Part 661, Department staff declared~ FINDINGS OF FACT 1o Applicant is the owner of a parcel of land, 9.54 acres in area, situated on Long Island Sound in the Village of GreeDport, Town of Southold, Suffolk County, New York, as indicated upon Attachment 1. 2. New York State Tidal Wetlands Inventory Map No. 718-55~ indicates the presence of tidal wetlands designated Littoral Zone ("LZ") along the Site. Inspection of the Site confi~-d-~ presence of a band of Coastal Shoals, Bars and Flats ("SM") ~n the intertidal zone. The area lying between the line of Mean High Water and the crest of the seaward face of the bluff or cliff, is designated Adjacent Area ("AA"). 3. Applicant's proposal to subdivide the Site into two lots, 5 acres and 4.54 acres in area, respectively, meets a~l of the requirements of the Tidal Wetlands Act and its implementing Land Use Regulations. The area of the proposed new lots would be well within the 40,000 square foot limitation contained in 6 NYCRR Part 661.6(a)(5). 4. Construction of a shoreline stabilization structure and the placement of fill in an A~jacent Area to tidal wetlands is a regulated activity and designated in 6 NYCRR 661.5(b)(27) & (29) as a "generally compatible use, permit required" ("GCp"). T}~e development restrictions contained in 6 NYCRR Part 661.6 are not applicable to the proposed Project. 5. The existing face of the bluff~ which Applicant seeks to stabilize shows some minor erosion in two locations; the eastern end of the Site, and near the center of the Site. In both places, the erosion appears to have proceeded from the top and moved downward, indicating that ground water had exited through the face of the bluff or that surface water from above had percolated through the porous soil and then moved down the face of the bluff. There is no indication of erosion caused by storm-driven water and wind along the toe of the bluff. 6. Applicant's proposal to install approximately 912 linear feet of sheet steel retaining wall, armored at the toe with -4- rocks, if appropriate in the instant location, would also be an appropriate erosion control device for substantially the entire north shore of Suffolk County. It is not possible to predict with any reasonable degree of certainty the likelihood or frequency of the storm that would cause significant damage to the Site. Applicant has suggested, simply, that such a storm is possible. 7. The top of the proposed steel wall would be at an elevation of approximately 9 feet above Mean Sea Level. The base flood elevation for the Site, which is in a velocity zone, is elevation 15 feet, Which indicates that storm surges and waves could strike the bluff in an area 6 feet above the proposed bulkhead. Hence, the bulkhead would be minimally effective to protect the bluff face during such extreme storms. 8. Some toe scour is visible along a bulkhead installed on the adjoining property, west of the proposed Project. Under extreme storm conditions, it is likely that the Applicant's proposed bulkhead would contribute to erosion of the stony beach and on adjoining properties, causing other owners to seek similar erosion control structures. 9. Applicant's Site includes a stony beach, strewn with boulders that provide significant protection from storm surges. The bluff, which is moderately vegetated, appears to be stabler except for the two previously discussed areas of erosion. CONCLUSIONS 1. Applicant's proposed lot-split meets the criteria of the Tidal Wetlands Act and regulations. 2. The policy of the Tidal Wetlands Act is to preserve and protect tidal wetlands and to prevent their despoliation and destruction, giving due consideration to the reasonable economic and social development of the state (ECL 25-0102). 3. Although the Site has experienced no erosion damage from wind and storm tides, Applicant contends that such damage could be caused at some time in the future by a storm of unusual force (a 50 year or 100 year storm). That argument could be applied to the entire north shore of Long Island. -5- 4. The erection of the proposed steel wall is not necessary for the reasonable development of Applicant's Site into two large building lots, as he has proposed. If the houses are set back from the bluff a distance of at least 100 feet, it may never be necessary to build protective bulkheading. Reasonable protection of the bluff could be obtained by some careful regrading of the face, planting of protective vegetation and, perhaps, by the placement of rock r,ip-rap along the toe of the bluff. It is probable that such a soft approach would afford a greater degree of protection than would the proposed steel wall. · 5. The proposed retaining wall would cause disruption along the toe of the bluff as large rocks were removed to permit driving of steel into the ground. Under high velocity storm conditions, the water could reach 6 feet above the proposed wall. Under storm conditions toe scour and erosion damage to adjoining properties is a probability. The record fails to establish a need for the proposed wall and, in addition, indicates that if erected, the wall would probably cause damage to the wetland area. RECOMMENDATIONS 1~ A permit should issue to the Applicant approving the proposed subdivision of the Site into two lots, as proposed. 2. The proposal to build a steel retaining wall should be denied. 3. Applicant should be encouraged to submit a plan to Department Staff for approval, providing for regrading the face of the bluff in areas where erosion has occurred or where the angle of the face should be reduced. Such plan should also provide for planting of vegetation to hold and protect the face of the bluff. Following its construction and placement of back- fill, the area will be heavily vegetated to stabilize. We see no correlation between the shoreline stabilization project and development of the upland. ~he latter must Pet all applicable zoning requirements and setbacks fr~om the crest of the bluff. We are dismayed that the DEC has again apparently ~dified its position on shoreline stabilization structures. Forn~rly, vertical walls with rip-rap protection were approved in a pro forma manner. This was done as the structures were shown to have no adverse effect upon adjacent properties or the beach in front. Placement well landward of ~W is a f~rther mitigation technique. We know of no recent studies which show that a project of this type will now have s~n~ adverse effects. We, therefore, urge you and the Southold T~ustees to approve the project as applied for.
