TESTUT, JR. , residinq at 227 Groton Place , West Hempstead, NY 11552 MSTRICT I l�,i 19a��T-i a.,•.a' o 12 j party of the second part, 17 21 2+9 `O� I WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last Sec- 076.0D will and testamer.,, and in consideration of -------------TEN (10 . 00) ---------- — Blk 01.00 dollars, Lot m2.pp0 paid by the party of the second part, does hereby grant and 00 release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and impro\ements thereon erected, situate, lying and being in the Hamlet of Southold, Town of 5•S� old, County of Suffolk and State of New York, known and designated as Lot No. 3 on a certain I-lap of "West Creek Development" filed July 6, 1937 as Map No. 1236, more particularly bounded and described as follows: BEGINNING at the corner formed by the intersection of the Northerly side of Sun Lane with the Westerly side of a 15 foot Right of Way; running thence Nprth 79 degrees 45 minutes 50 seconds i\bst along the Northerly side of Sun Lane, 45 feet; thence North 26 degrees 44 minutes 10 seconds East, along the Easterly side of Lot 2 on said Map 93.5�ef t to the ordinary high water mark of v1 West Creek; thence Easterly along the ordinary high water mark of West Creek 45 feet more or less to the Westerly side of said Right of Way; thence South 26 degrees 44 minutes 10 Seconds PIest along the Westerly side of said Right of Way 102 feet more or less to the corner and point or place of beginning. TOGETHER with all right, title and interest of the party of the first part in and.to the waters and the land under the waters of said West Creek between the extensions northeasterly of the boundary lines of the premises hereinabove described from said ordinary, high water mark of West Creek to the center line thereof, as shown on said map. ALSO, with a right of way over said 25 foot private road known as "Sun Lane" and over a 25 foot private road known as "Bayberry Road", and over said 15 foot right of way as shown on said map. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payigedt of the cost of the improvement before using any part of the total of the same for any other purpose. Th7e word "party" shall hecconstrued as if it read "parties" whenever the sense of this indenture so requires.
