The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval, In the
even~ that such approval is necessary, the holder of this permit shal not commence operations here-
under until such approvat has been obtained in writing. The failure to obtain such other approval when
required shall sumject this permit to immediate revocation by the Trustees upon receipt by the
Trustees. of written notice from such other governmental or municipal au thorities of its refusal or
disapproval, ' '
The applicant does by the acceptance of this permit, assume all responsibility for operations Jnder-
taken ~ursuant to this 3ermit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occu pants of the premises u oon which the operations authorized by
mis permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion., turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

A detailed description and plans of the applicant's activity are inclosed
to assist in your review.
The decision whether to issue a permit wit] be based on an evaluation of
the probable impact including cumulative impacts of the activity on the
public interest. That decision will reflect the nmtionai concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to ~crue from the activity must be balanced
against its reasonably foreseeable detriments. Al/ factors which may be
relevant ro the activity will be cossidered including the cumulative
effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fis. h and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation,
waBer quality, energy needs, Bafety, food productiom and. in general, the
needs and welfare of the people.

Amy person may request, in writing to the district engineer, before this
public notice expires, that e public hearing be held to collect information
necessary to consider this application. Requests for public bearings shall

carefully in the permit decision process and bears the same weight aB that
furnished at a public hearing.

Pursuant to Section 7 of the Endangered Species Act (15 II.S.C. 1%'~1) and
baaed upon a review of the latest published version of the ghteatened and
endangered species listing~ a preliminary de~ermination is ghat the
activity under consideration will not affect those species listed or ~heir
critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible ~or or
included in the Register within the permit area. Presently unknown
archeologicai~ scientific, prehistorical or historical data m~y be lost by
work accmm~plished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Nater Act will
include application of the guidelines promulgated by the Administrator~
U.S. Environ~ntal Protection Agency, under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate s~ate agency in accordance with
~ n h0l of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16 UBS.Co 1456(c)), for activities under consideration that are
located within the coastal zone of a state w~ich has a federally approved
coastal z3ne m2tnagement programs the applicant has certified in the permit
application that the activity complims with and will be conducted in a
program. By this pablic notice, we are reqaesting the state's concurrence
with, objection to~ or waiver of the applicant's certification. No permit

DESCRIPTION OF WORK
The applicant, Arthur Bujnowski, nequests Deoartment of the Army
authorization to construct a timber groin in Peconic Bay, au Bayview,
Suffolk County, New York for the stated DUrDOSe of erosion control.
The work would ~nvolve the construction of a 30 foot long timber groin
of low profiTe design. The vertical elevation of the structure would
not exceed the level of mean high water and the most seaward pile would
be au a vertical elevation of +3 mean high water. The compartment
between the proposed structure and the one to the east is 10 feet in
width aha one third of this compartment would be pre-filled with 60
cubic yards of clean sand.

level of MHW, the most seaward pile shall be at a vertical
elevation of 3' above MHW. The compartment between the proposed

with clean sand. Said fill activity will be performed periodically
to minimize adverse downdrift effects by supplying sand to the
littoral transport system. At the initial time, approximately
60 c.y. of sand will be placed in the compartment. The source

At the regular meeting of the CAC the following recommendations
were made:

Wetland Application No. 334, John Xikis - Disapprove, the Council
feels the present wall is serving its purpose, :here is no
need for bulkheading. Also of concern is the severe impact on
the downdrift neighbors of the proposed groin. In addition~
creation of additional land to an existing beach is contrary
to the existing wetlands ordinance. In conclusion, the
applicant should leave AS IS, the svones and screens appear
quite secure. The cove is sheltered from the northwest.
Wetland Application No. 337, Joseph Schoenstein Disapprove, The
Council sites four reasons for its recommendation. They are as
follows:
1) Creek is about :o be designated as a significant habitat.
It is critical to vast freshwater wetlands and uplands as
far north as ~oores Woods.
The setback is nov observed with care on the present lot.
Rubble fronting on creek and banks are already a hazard.
The building can be sited perpendicular To current plan.
Town ordinances arealready in question due to expansion
of facilities and previous variances.

The Council recommends disapproval because the pool, is
within ~he 75' setback requirement. The bulkhead represenvs
a severe alteration of the shoreline convour. Without the
pool the retaining wall has no function. The Council suggests
an alternative by placing the pool on the north side of the house.

that there were objections by neighbors, the Council decided
to table the application pending a meeting of all those
neighbors concerned in the surronding properties. They ,ne~d
find a solutio~ to best handle the problem o£ erosion and
property loss. The Council feels the proper~y owners
need an expert in littoral drily to advise on proper plac~e~

The Southold Town Conservation Advisory addressed Wetland
Application No. 659, No. 660, No. 661, No. 662, No. 663 and
No. 664 as an omnibus motion. Applicants are: Monica Kenny,
Gilbert Pinkham, Joseph H. Williams, Nickolas Pace, Charles
M. McCormick, and Canning Elliffee.
RESOLVED to recommend to the Southold Town Trustees approval
with recommendations for applicants ~o remove and replace
existing bulkheads mn same location and configuration, and
dredge as requested with speil being place as per requested
in applications. The CAC wishes all applicants be advised
that lawns grown to the edge of a bulkhead can cause wa~er
pollution. The Council recommends that there be no fertilzation
within 20' of the bulkheads and recommends that natural would
be best within the 20' buffer. Natural vegetation would act
as a filter for any runoff which may occur from the properties.
Lake Drive and Reydon Drive, Southold.
RESOLVED to recommend to the Soufhold Town Trustees disapproval
of Wetland Application No. 665 of Southold Shores Boat Basin,
Inc, to enlarge an existing, private, non-commercial mooring
facility at allow for 21 slips, one for each home owner in
Southold Shores. This shall include the addition of an additional
385' of 4' wide float docks as per submitted plans. The CAC
disapproves project as submitted. The Council suggests the
applicant extend the existing dock out to accomodate the extra
slips. The Coucnil is concerned that the configuation, as submitted,
would increase the number and size of boats in the small waterway
which could cause environmental problems.
Foot of Blue Marlin Drive, Southold.
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 666 of Arthur J. Bujnowski to
construct a timber groin of approximately 35' in length as
submitted. The CAC feels there is no need shown for the project,
a beach cannot be created, and projec~ would damage downdrift.

RESOLVED to advise the Southold Town Trustees that, to the Council's
knowledge, at present, there is not any problems with the
Planning Board subdivision, Long Meadow Estates.

RALPH PANELLA: My name is Ralph Panella. I live down the
beach from Mr. Bujnowski, west of hi~Lprope~ty. I would like
to also include my neighbor, west of me in this objection to the
construction Mr. Bujnowski proposes. We feel it will erode the
sand and beach west of the Bujnowski property. We would also
like to enclude that if this application is approved that prior
to his approval we have expert testimony that this would not
adversely affect the beach west of the Bujnowski property and
in addition to that if the project is approved we would like to
have him post a bond that he would fill in the compartment more
than just periodically because as we all know wi~h sand taken out,
it would have to be replaced and we have no guarantee that he will
do that-to protect the beach west of this property.
TRUSTEE SMITH: Thank you. Do any of the Trustees have anything
to say?
TRUSTEE KUJAWSKI: Did the Conservation Advisory Council give any
comments on this application?
SECRETARY: The Council recommended approval.
F~RTIN GARRELL: If I remember correctly this was among a
group of jetties along that beach. I don't have a map° It seemed
like there were ten of them. We didn't see the need for the

structure but we felt he wouldn't do any harm with it.
Obviously we didn't conduct a study of the littoral drift.
We didn't consult with anyone regarding the drift in that
area. There were~no objections at that time, and we
approved it as a moUtine~matter. If you want us to take
another look at it I would be happy to do so.
TRUSTEE SMITH: Thank you. Mr. Just do you have anything
to say?
GLENN JUST, LAND USE COMPANY: The only comment I have is that
the New Yo~k State Department of State, Division of Coastal
Management has a new policy of looking at these different jobs.
Whereas they request the prefilling ahead of time. They have
no set period of time or bond that they request when they
fill periodically. ~They have no set time. They will deny
any application that does not have the prefilling
ahead of time.
TRUSTEE SMITH: Thank you.
RALPH PANELLA: I would like to further comment regarding the
beach along that area. Just East of the Bujnowski property there
is a grein that has been there for many, many years. When you
look wes5 of the property you can see how the property eroded
out in a horseshoe shape. Continuing further west of this
property and past my neighbors property, Ted Zang, is another
groin that has been there for many, many years and past that leads
into Corey Creek. You can see how the beach has completely
horseshoed out. So we feel that by putting more groins in,
that it will further deteriorate the beach west of the
Bujnowski property. That is why we feel it should not be allowed
to be p~_in.
TRUSTEE SMITH: Yes, that area west of that groin there by

put there by the County Dredge. That isn't a natural beach there.
You really have no way of telling where that sand is going to.
MR. PANELLA: That was placed there, I believe, last year.
within the year ~t was taken right out. It was prior to that I
understand that that area was d'redged and Corey Creek inlet.
It just doesn't seem to stay. We feel the littoral drift is
affected ad~srsely in that area. As I said, the property just
East of B~3nowski, I don't know the property owner at that point,
but there is a groin that has been there for many, many years.
Just west of Bujnowski it has eroded the beach completely. It
is getting worse every year. Of course we had the hurricane this
year.
Public Hearing In the matter of Arthur J. Bu3nowski.
TRUSTEE SMITH: I think Mr. Bu3nowski has a problem there also.
RUTH OLIVA: Just a point of history, about five years ago we
objected to a 3etty that was put up down there by Mr. Laotis.
It went t~ a D.E.C. hearing. The problem there was that the
littoral drift f~wsgo from East to West. There was one
long jetty that stuck out to the East of Mr. Latois' property
perhaps 100 ft. Our objection there was "What is the point of
putting that up when the problem was the 100 ft. ~etty"?
The D.E.C. ruled not to take that down. That has been the ~_
problem all along there. I think if you look back, there has
been another jetty put out. I think by the Association down
there to proteCt the beach. They had a beautiful Property
Owners Assication beach down there and they ended up because
of Mr. Latois' p~tt~ng~up his groin, then the ~roperty Owners
Associat±~n had to put up their groin. I'm not to sure how far
West this gentlemen is, but Mr. Bujnowski is to the Wes~t of
that. You2_know it's the old story "You put up a whole field
of them or none at all.
TRUSTEE SMITH: Thank you. Does anyone else have any comments
for or against this application? Hearing no further comments,
President Smith closed the hearing at 8:18 P.M..

Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44
of the Code of the Town of Southold, notice is hereby given that
the Southold Town Trustees, as lead agency for the action
described below, has determined that the project will not have
a significant effect on the environment.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: To construct a timber jetty of approximately
35' in length. Jetty will be of low profile design. The verticle
elevation of the structure will not exceed the level of MHW, the
most seaward pile shall be at a verticle elevation of 3' above MHW.
The compartment between the proposed structure and the one to the
east shall be completely filled with clean sand. Said fill activity
will be performed periodically to minimize adverse downdrift
effects by supplying sand to the littoral transport system.
LOCATION OF PROJECT: Town of Southold, Country of Suffolk, more
particularly known as: 1365 Watersedge Way, Southold, New York,
11971.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that no significant adverse effect to the
environment is likely to occur should the project be
implemented as planned.
2. Because there has been a response from the Southold Town
Conservation Advisory Council indicating that this project
would not have a significant effect to the environment.
3. Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation and the Southold Town Building Dept., it is
assumed that there are no objections nor conunents from
those agencies.

Gentlemen:
This letter is being submitted to you in opposition to the
application of Mr. Arthur J. Bujnowski to construct a timber
jetty in Peconic Bay.
My property is located on Peconic Bay west of Mr.
Bujnowski's property. Like Mr. Bujnowski, I, too, have suffered
a great deal of erosion to my property. Some of this erosion
has been caused by storms. Most of it, however, has been caused
by a westerly littoral drift which carries sand from the
shoreline east of Corey Creek into Corey Creek, itself.
Mr. Bujnowski's proposed jetty would take advantage of this
drift to trap sand in front of his property and, thereby, to
solve his problem. Unfortunately, though, it would do so to the
detriment of the shoreline west of him which then would lose
nourishment of the sand being retained by the jetty.
Indeed, ali of you must be aware of the havoc being caused
by jetties on the Sound shore. Mr. Bujnowski's jetty would
contribute to the same kind of problem on the Peconic Bay shore.
Rather than approve Mr. Bujnowski's application, would you
not consider the following aiternative solution which could
benefit Mr. Bujnowski and everyone else. Recommend to the Town
that it build a groin immediately east of the entrance to
Corey Creek. Such a groin would help preserve the shoreline by
preventing the loss of sand into the Creek. Also, its cost
would quickly be paid for by the savings that would result from
not having to dredge the entrance to Corey Creek every two or
three years.

Pursuant to Section 7 of the Endangered Species Act (16 U.S,C. 1531) and
based upon a review of the latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.-
Baaed Upon a review of the latest published version of the National
R~gister of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will
include-application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456(c)), for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit
application that the activity complies with and will be conducted in a
manner that is consistent with the approved state coastal zone management

The project consists of reconstructing a forty-three foot, low profile,
timber groin which will attach to an existing bulkhead. Approximately
twenty feet of the groin would be located seaward of the mean high water
line (MHW) with the remaining: twenty-three feet constructed above the MHW
line, and attached to the existing bulkhead. Sixty cubic yaPds of clean
sand would be placed below the MHW line between the proposed timber groin
and an existing timber groin east of the project site.

the Southold Town Trustees, as lead agency for the action
described below, has determined that the project will not have
a significant effect on the environment.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: To construct a timber jetty of approximately
35' in length. Jetty will be of low profile design. The verticle
elevation of the structure will not exceed the level of MHW, the
most seaward pile shall be at a verticle elevation of 3' above MIiW.
The compartment between the proposed structure and the one to the
east shall be completely filled with clean sand. Said fill activity
will be performed periodically to minimize adverse downdrift
effects by supplying sand to the littoral transport system.
LOCATION OF PROJECT: Town of Southold, Country of Suffolk, more
particularly known as: 1365 Watersedge Way, Southold, New York,

REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that no significant adverse effect to'the
environment is likely to occur should the project be
implemented as planned.
2. Because there has been a response from the Southold Town
Conservation Advisory Council indicating that this project
would no~ have a significant effect to the environment.
3. Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation and the Southold Town Building Dept., it is

Applicant proposes to construct a timber jetty of cpprox-
imately 35' in length. Seid jetty will be of a 1Ow profile
design. The vertiole elevation of the strueture~will not
exceed the level of MHW, the most seaward pile shall be at
a verticle elevation of 3' above MHW. The compartment
between the proposed structure and the one to the east shall
be completely filled with clean sand. Said fill activity
will be performed periodically to minimize adverse downdrift
effects by supplying sand to the lettoral transport system.
