Dear Mr. Kelly,
he following action was taken by the Board of Town Trustees
during its regular meeting held on June 27, 1996, ~egarding the
above matter:
W~LEREAS, ROBV~T & C~RISTABROWN, applied to the Southotd
Town TruStees for a peri, it under the provisions of the wetland
Ordinance of the Town of Southold, application dated Jttne 12,
1996, and,
WHEREAS~ said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 27, 1996, at which time all
interested pe~rsor~, were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surroundinq area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WMF. REAS, the str~cture complies with the s~ndard set forth in
Chapter 97-18 of the Southol~ Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
.RESOLVED, that the Board of Trustees approves the application of
ROBERT & CHRISTA BROWN to construct 1,800 s.f. building with
18 gravel parkinq spaces and sanita~r!z s!zstem. Located: Route
_25, Greenport.
BE IT FURTHER RR~OLVED that this determination should not be
considered a determination made for any other~epartment or
Agency which may also have an application pending for the sa~e
or similar project.
Permit to construct project will expire two t~ars fro~the date

At' the meeting of the Southold Town Conservation Advlsor~ Council held
MONDAY, JUNE 2~, 1996 the following recommendation was made:

Moved by Allan Connell, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of
of the Wetland Application of RO
1800 s.f. office building with sanitary system
and 18 parking spaces with bluestone surface.
The Council recommends approval provided runoff be contained on site
during and after construction and that applicant protect the wetlands from
sedimentation during construction.
The CAC also recommends the applicant be fined for commencing work
without a permit.

A l'~eld inspection was made on thc above referenced parcel to dete:mfine
the presence of wetlands on the property and wiflfin 75 feet of tim properly
boundaries. 5ubjem property is located adjacent to and west of ~illy'5 Bistr~
Restaur~t.
Subject parcel contains a house and shed, There ia no question tha't the
parcel has uudergone disturbm~ce and several apple trees arc tbund in lite backyard
area. Thc vast majority of vegetation fom~d on site is described as upla,d. These
uplalld species include: beach, sycamore ~naplc, spruce, bluestem gra,qses, pin oak,
blaekbeny, flat topped goldenrod, fox grape, locust, ragweed, Virginia ro~e,
raspben3, and vine honeysuckle. Facultative wetland plants are lhnited m
wimerberry and red maple. Based upon the presence of these plants, il. is
concluded that no wetlands arc present.
The properly lies beyond 100 feet fi'om thc Iai'ge red maple swamp locally
lmown as Moores Drain. Therefore, there is no need for the property owner obtain
a Town Trustee Permit nor a N YSDEC Freshwater Wetland Permit.
ApproxinmleJy, 300 filet west of subject properly lies a site form}dly used
as a gas stalion. The site contains phragmites and Juncus effusus with the red
maple swami> of Moores Drain lying m the backdrop.
