The applicant does by the acceptance of this permit, assume all responsibility for oueradons under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to aersons
and property resulting, from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the Owner and occupants of the premises upon which the operations authorized by
this permit are being condqcted dn hv the ~¢ceotance of this permit, give consent to the Town. and
Its officers and employees to enter upon the premises where such operations are being conducted to
make suc~. insoections as the Town may deem necessar¢ to insure that such operations are being con-
ducted in conformity with this permit.
Thi~operation will not substantially:
A. Adversely affect the wedan0s of the town.
g. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish o.r other beneficial marine organisms, aquafic wildlife andvege-_
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity. ' -

Dear Mr. Costello:
The following action was taken by the Board of Town Trustees during
their regular meeting held on July 27, 1987 regarding the above matter.
WHEREAS, Howard R. Brower, Jr. applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated May 13, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on July 27, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises ~n question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined Shat the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that Howard R. Brower, Jr. BE AND HEREBY IS GRANTED PERMISSION
UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO:
Construct a 30" x 20' ramp and a 6' x 20' float dock to be secured by two spiles.
Property is located at 1170 Eugene's Road, Cutchogue.

This permit will expire on July 27, 1989 if work has
not commenced by said date. q]here are two inspections required and
the Trustees are to be notified upon the completio~n of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that l~e has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit ~n such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured, Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
The following fees are now due and payable. Upon remittance your
permit will be forwarded by mail.

This notice is issued pursuant to the provisions of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the
Code of the Town of Southold, notice is hereby given that the-Southold
Town Trustees, as lead agency for the action described below has determined
that the project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency which
may also have an application pending for the same or similar project.
TYPE OF ACTION: UNLISTED
DESCRIPTION OF ACTION: TO INSTALL A FLOATING DOCK 6' X 20~ SECURED BY TWO
(2) GALVANIZED PIPES AND INSTALL A 30' RAMP.
LOCATION: 1170 EUGENE"S ROAD, CUTCHOGUE.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has beem submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.

Gentlemen:
In 1987 the Trustees gave permission to
~1r. Steve ~itacchione, owner of the meadow on
the east side of the head of East creek (some-
times knov~ as Eugene's creekS, to dredge a
channel 500' long ~ud 40' wide along the edge
of the creek and his property to connect with
the main channel dredged in the 1960~s. The
dredged material was put on the meadow which
now comprises lots 97-6-1,1 ~ud 1.2.
The present owner~of lot 97-6-1.1,
Nr. Howard Brower, Jr., has submitted application
#538 to build a 30' ramp with a 6' x 20' float
which would extend approximately 36' from
mean high water into the ~creek. It seems to
me that if he were to park his boat in front
of the float, it would block~ off the cha~n~el.
I respectfully request that whatever ~lans
you approve will allow me approximately 10 -
clearance to go in and out with my boat. Ny
property is adjacent to his and I have been
using the channel since it was dredged.

Please be advised that Mr. Allen was in to the office today. Me was asking
about an application by Costello Marine Contracting for Howard Brower. It seems
that the dock proposed may be obstructing the channel in the area. At first he
was complaining about an offshore mooring with a pulley line that was obstructing
the channel. Well, it's the dock that he is concerned with now. I gave you the
information on the mooring and the dredging. You may want to have the applicant
amend the size of the dock to bring it back some?
