TOGS= with all right, title and interest of the party of the first part in and to the beach in front of the above described premises to the ordinary high water mark of Mattituck Creek, which beach is more particularly described as follows: BEGINNING at a point marking the northeasterly corner of the within premises, which point of beginning is situated S. 290 301 E. 205.00 feet from a monument set on the southerly side of Westview Drive and which monument marks the northwesterly corner of ]and of Sellars, formerly Banner, and the northeasterly corner of land of Burns and from said point of beginning running S. 290 301 E. 110 feet more or less, to the high water mark of Mattituck Creek and running thence westerly along said high water mark to a point, which point is situated S. 240 001 E. 130 feet, more or less, from the southwesterly corner of land of Burns, UBER5847 PAu416 and running thence N. 240 001 W. 130 feet, more or less, to a point and land of Burns, running thence along said land of Burns 11, 620 161 10" E. 63.77 feet to the point or place of beginning. Being and intended to be all of the "filled area" lying between the high water mark of Mattituck Creek as fm..nd in 1950 and the 'high water mark of 1964 and particularly being and intended to be the same premises described in deed from the Trustees of the Town of Southold to John F. Burns, dated October 26, 1964 and recorded in the Suffolk County Clerk's Office in Liber 5645 at 10. The conveyance hereunder is subject to a certain mortgage executed by John F. Burns and Bertha E. Burns, his wife, as mortgagors to Southold Savings Bank as mortgagee, which mortgage is dated April 12, 1961, and was recorded in the Suffolk County Clerks Office on April 18, 1961 in Liber 3608 mp 262, and on which mortgage there is now due the sum of §12,251.55 with interest thereon at the rate of six per cent per annum from October 12, 1965, and that the grantee hereby assumes and covenants to pay such mortgage debt and interest as part of the consideration for this conveyance. i
