successors and assigns of the party of the award part forever,
ALL that certain plot,piece or parcel of land,JBd[ situate,
tying and ban in thx Mattituck, Town of Southold, County of Suffolk
and State of New York, known and designated as Lots 101 and 102,
on a certain map entitled, "Map of Captain Kidd Estates at Matti—
tuck Inlet" and filed in the office of the Clerk of Suffolk
County on January 19, 1949, as Map No, 1672.
SUBJECT to the following covenants which shall run with the land.
1) The grantor herein shall have the right to tap in to the main
water main and connect water service lines, without charge for
tapping, or the grantor may use the grantee's facilities and pay
the grantee a tapping fee.
2) For a period of five (5) years after the closing of title
the annual water service charge shall not exceed $40.00 and the
annual water service fee shall be the same for all customers.
On and after five (5) years from the closing of title, the grantee
or its assigns shall have the right to establish water service
charges as they see fit subject only to restrictions that may
be imposed by municipal authorities.
3) All purchasers of land in Captain Kidd Estates shall have an
assignable right to water service subject to payment for said
water service.
4) No water service lines or mains may be installed less than
4% feet in depth from the surface and all water service lines
shall have a curb valve and curb box installed on the outside
of the front property line.
There has been executed and delivered simultaneously herewith, and
intended to be recorded, a purchase money first mortgage in the
sum of Sixteen Thousand and no/100 ($16,000.00) which mortgage'
is dated March 1, 1965 and was made and executed by the vendee
herein to Dawn Estates, Inc., a domestic corporation with its
Principal place of business at 14 Dawn Drive, Centereach, New York.
