RESOLVED that whereas, A formal application for the approval of 'a subdivision plat entitled Minor Subdivision. of Joseph Gajeski was submitted to the Planaing'Bcard on August 220 1980 and an application fee of 50 was—paid on November 3, 1980, and WHEREAS, a; public hearing was held on the said subdivision application and plat at the Town Hall, Southold, New York, on November 3, 1980 at 8:15 prtm.,',and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been,met by said subdivision plat and application, Now, therefore, be -it RESOLVED that the application of Joseph Gajeski for approval of said subdivision plat prepared by R. KUJAWSKI, being duly sworn, deposes and says: That I am the executor of the Last Will and Testament of Joseph Gajeski, deceased, who died on January 18, 1982. At the time of Joseph Gajeski's death he was the owner of a parcel of land on the westerly side of Maple Avenue, Southold, New York. He acquired this particular parcel as part of an estate distribution under the Last Will and Testament of Antone Gajeski who died in 1962. Antone Gajeski had owned this parcel since 1927. The property with the adjacent property to the north was subdivided pursuant to a variance received from the Southold Town JBoard of Appeals dated August 27, 1980, a copy of which is attaches Ihereto. Located on the property is a two-story frame dwelling in good condition, two sheds and a garage all of which have been used as la residence since 1927. This application is made for the purpose of obtaining a pre- existing Certificate of Occupancy from the Building Department of the Town of Southold. Jo phine H. ZONING BOARD OF APPEALS FORM ZB4 After investigation and personal inspection of the premises, the Board finds that applicant purchased two parcels of _land located on the west side of Maple Avenue (Private Road No. 7), Southold, which became merged as one parcel when the properties were conveyed to the same name. Proposed Lot No. 1 will have 38,582 square feet -cf area and -66.50' in width, and has an existing barn . Proposed Lot No. 2 will have 25,087 square feet of area and 150 feet in width, and has an existing two-story farm house, two sheds, and a garage. Also, the access road, known as Maple Avenue, has been preexisting of zon- ing, is approximately 68.81 feet wide; and is suitably improved for egress and ingress to the subject parcels. The Board agrees with the reasonings of applicant. The Board finds the circumstances present in this case unique, and strict application of the ordinance would pro- duce practical difficulties or unnecessary hardship. The ` Board believes that the granting of a variance in this case will not change the character of the neighborhood and will y observe the spirit of the ordinance. On motion by Mr. Grigonis, seconded by Mr. Tuthill, a it was RESOLVED, that Joseph Gajeski, by Richard F. Lark, Esq., Main Road, Cutchogue, New York 11935, be granted Variances to: (a) the Zoning Ordinance, Article III, Section 100-31 approving the insufficient area of two proposed parcels as applied for, to wit, 38,582 and 25,087 square feet, and approving the insufficient width of Lot l as applied for, to wit, 66.50 feet; and (b) New York Town Law, Section 280-A approving the access, as applied for, in Appeal No. 2719 dated July 11, 1980, SUBJECT TO THE FOLLOWING CONDI- TIONS: (1) That applicant obtain approval from the Southold 41 Town Planning Hoard concerning the division of this property; (2) That no structures be built within 170 feet from Maple Avenue into "Lot No. 2."
