Box 2124 Greenport, NY 11944 RE: ROBERT SINGER & LYNNE VITALE 1865 LITTLE PECONIC BAY LANE, SOUTHOLD SCTM# 1000-90-1-12 Dear Ms. Costello: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, January 17, 2018: WHEREAS, Costello Marine Contracting Corp., on behalf of ROBERT SINGER & LYNNE VITALE applied to the Southold Town Trustees for an Amendment to Wetland Permit#1992 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 4, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit#1992 to construct a 10' long retaining wall in order to connect the existing bulkhead to the retaining wall on adjacent property; fill void areas landward of wall with clean trucked-in fill as needed; and as depicted on the revised site plan prepared by Costello Marine Contracting Corp., dated January 29, 2018, and stamped approved on February 7, 2018. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are-required at a fee of $50.00 per inspection. (See attached schedule.) As a result we have concluded that although you may own some of the underwater land in front of your home we can not permit the removal of any material under a grandfather permit. This is because the only time we permit any material removed is under a full wetland permit. This has been a matter of Board policy for all applications. A second search of our files indicated you have a permit for your dock. I must. apologize that this was not located previously. As you now have a permit for this bulkhead, the Trustees haveno objection to its replacement at this time - provided it is replaced in kind-in place. For you to dredge you will need to file a full wetland permit application. We will credit the grandfather permit fee towards your full permit fee should you decide to file such an application at this time. Although we are aware of the surface runoff impacts to West Lake, the Trustees position with respect to vegetating, re-vegetating or natural re-vegetation by your bulkhead remains unchanged. Should you wish to remove material as part of a dredge plan it is unlikely that we would permit disturbance of areas which are developing a healthy Spartina Alterniflora fringe. You might also be interested to know that should dredging be deemed necessary the Board would not likely charge,you for the volume of material removed as your letter provides sufficient evidence of your ownership of the bottom.
