Breneisen to amend the Wetland Permit no 226 to reflect the addition of a 56' retaining wall and a 12' return extending eastward from the west property line in line with the eroded area. Breneisen Dear Trust~es: Pursuant to the above issued permits I am requesting an ammendment to the ones issued at the request of the applicant. I am at the job site now and I has come to my attention that the seawar] west area of Mr. Breneisens property is eroded and a small retaining wall is necessary. I would like to complete this work While I am at the site.~ I hav~ installed the upper 100' of retaining wall. Rather than jet pump the Sheathing into pla6e I excavated using a backhoe. The reason I used this method, although a jet pump is faster~ was to protect 'the marsh area infront of the retaining wall.. When you use a backhoe a dike of sorts is created which prevents any sandy soil from washing over the grasses. I am enclosing pictures of where the retaining wall is needed and an updated original drawing. I wo~Id appreciate a decision on this as soon as possible. Mr. John Costello: Yes, my name is John Costello from Costello Marine Contracting. I am the agent for Mr. Albert J. Breneisen. I personally was involved with the design of the retaining wall for Mr. Breneisen. There has been comments of concern last meeting upon being an important shellfish area, which Gull Pond is. Both retaining walls have been designed to be well above high water. Probably the last six or seven structures approved have been_~in the water to the wetlands. This one is above. It is on a sloping hill. We are trying to stop some of the run-off off the lands from going onto the wetlands. It also has a small area on the Southwest corner of the property which has slight erosion. I have tried to tell Mm.~Breneisen that it does not need a bulkhead or retaining wall in that spot. I have told Mr. Breneisen that by planting grasses and staying off of that area, the grasses will come back naturally these~ He intends to put in a swimming pool behind the retaining wall. He has the property and it is upland, and it will not interfere with any of the wetlands. If there are any questions, I will be happy to answer them. Trustee Kr~pski: Yes, I have a question. Why aren%~ .the two retaining walls connecting one another? Mr. Costello: There are two different ~levations on the property. The East one, if you are looking to join them, will require additional fill on the property. He has cesspools in that area, which you would not want to harm. Fill is also expensive. It also allows for a walk- way through the retaining walls and down to an existing floating dock thaf Mr. Breneisen has there. Thank you. Public Hearing in the matter of Albert J. Breneisen Page 2. Trustee Smith: Is there anyone else who wishes to come before the Board regarding this application? Ruth Oliva: Henry, may I ask a question? Trustee Smith: Surely. Ruth Oliva: How is he going to drain the pool? Mr. Costello: I am not the builder for the pool construction. I am sure that the recommendation that the Board will give will say something about the draining? Ruth Oliva: Don't they drain these pools? Trustee Bredemeyer: Most people leave the water in the pool so that it does not collapse. I had an opportunity to question several people with regard to this. I had witnessed the discharge of a commercial pool in one of our creeks recently. I do work sort of in that allied area. The general feeling was that at the end of the season, where the pool is not in use, and there is probably no algicide or chlorin~ residual left in it. ~It is probably of minimal envi- ror~ental consequence. The pool that was dumped was a large pool, and the D.E.C. and the Health Depto was not .concerned, at that time. Ruth Oliva: It is just the chlorine that evaporates? Trustee Bredemeyer: They use PH control~and other things. But, generally speaking the PH is approximately within. ±~fractionaI points of 7 so it is not particularly harmful. As usually the case people put pool covers on the pool during the winter. The water is expensive to fill. People usually do not empty the pool.
