authorities. The Town accepts no responsibility 'c applying for or obtaining such approval. In the
even~ that such approval is necessary, the holder of this oermit shall no[ commence operations here-
under un til such approval has been obtained in writing. The failure to obtain such other approval when
reuuired shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees of written notice from such other governmental or municipal authorities of its refusal or

INSPECTION CHECK OPF SHEET
In accordance with Chapter 97, Article ti, Section 97-28
the Trustees may 'adopt a resolution directing the issuance of a
permit to perform operations applied for only if it determines that
such operations will not substantially:
Adversely affect the wetlands of the Town.
Cause damage from erosion, turbidity or siltation.
Cause saltwater intrusion into the fresh water resources
of the town.
Adversely affect fish, shellfish or other beneficial marine
organ~sams, aquatic wildlife and vegetation or the natural
habitat thereof.
Increase the danger of flood and storm-tide damage.
Adversely affect navigation on tidal waters or the
Tidal flow of the tidal waters of the town.
Change the course of any channel or the natural movement
or flow of any waters.
Weaken or undermine the lateral support of other lands in
the vicinity.
Otherwise adversely affect the health, safety and
general welfare of the people of the town.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
APPLICATION NO. 338
NAME: Albert Breneisen
This notice is issued pursuant to the provisio~s of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the
Code of the Town of Southold, notice is hereby given that the
Southold Town Trustees, as lead agency for the action described
below has determined that the project will not have a significant
effect to the environment.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: To construct an upper (110'} and lower
(75') retaining walls and a 20' x 40' .swimming pool and to excavate
150 cu. yds. for pool 50 to 70' above MHW.
LOCATION OF PROJECT: Dawn Drive, East Marion, New York or more
particularly known on the Suffolk County Tax Map as 1000-035-5-16.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form in the short form has been
submitted which indicated that there would be no adverse effect
to the environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Department and the New York State D.E.C.
it is assumed that there are no objections nor cormments from those
agencies.
