Box AK Greenport, NY 11971 Dear Mr. Brasby: Reference is made to your Application No. 82-737-L2 to replace 100 feet of bulkhead in Southold Bay, Southold, Suffolk County, New York. The repair, rehabilitation, or replacement of any previously authori- zed, currently serviceable, structure or fill or of any currently serviceable structure or fill constructed prior to the requirement for authorization are permitted by 33 CFR 330.5 (a) (3), as published in the 22 July 1982 Federal Register, provided such repair, rehabili- tation, or replacement does not result in a deviation from the plans of the original structure or fill, and further provided that the structure or fill to be maintained has not been put to uses differing from uses specified for it in any permit authorizing its original construction, and the attached conditions are met. If the above mentioned project does not satisfy these conditions a formal permit application must be submitted. Care should be taken so that construction material (to include debris) do not enter the waterway and become a source of drift.
