The validity of this permit is or may be subject to the approval of other governmental or municipa
authorities, The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here
under until such approval has been obtained in writing. The failure to obtain such other approval wher
required shall subject this permit to immediate revocation by the Trustees upon receipt by th,
Trustees of written notice from such other governmental or municipal authorities of its refusal e
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and

make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

This notice is issued pursuant to the provisions of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the
Code of the Town of Southold, notice is hereby given that the—Southold
Town Trustees, as lead agency for the action described below has determined
that the project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency which
may also have an application pending for the same or similar project.
TYPE OF ACTION: UNLISTED
DESCRIPTION OF ACTION: To devegetate and fill to raise the grade to construct
a house.
LOCATION: NEW SUFFOLK AVENUE, NEW SUFFOLK
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the .New York. State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.

Within sixty ('60) days Respondent shall have supplied an

WHEREAS, Article 25 of the New York State Environmental
'Conservation Law (TidalWetlands Act) specifically §25-0401,
prohibits the excavation and removal of any material or the dumping
for filling of any material without the requisite permit and
WHEREAS, the Department of Environmental Conservation (DEC)
Hhas documented a violation of said statute in that Respondent caused
grand/or` permitted to be caused," the clearing and grading in and
,adjacent to a regulated tidal wetlands area without permit at New
?ISuffolk Avenue, New Suffolk, New York; and
WHEREAS, Respondent has affirmatively waived its, right to a
;public hearing in this matter in the manner provided by law and
having consented to the entering and issuing of this Order, agrees to !
be bound by the terms and conditions contained herein.
NOW, having considered this matter and being duly advised,
it is
ORDERED, that with respect to the aforesaid alleged violation,
there is hereby imposed upon Respondent, a penalty in the sum of
Seven Hundred Fifty ($750) Dollars, which shall be made payable to

The following action was taken by the Board of, Town Trustees during their
regular meeting held on July 27, 1987 regarding the above matter.
WHEREAS, William F. Beal applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated May 18, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on. July 27, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises .in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that William F. Beal BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE 'TOWN OF SOUl'HOLD TO:.

insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project:
Please return to the Building Dept. for a determination on the need of
any other Town Permits that maybe required for this project.
Please remit $10.00 for Wetland Inspection fees at this time.

Code of the Town of Southold, notice is hereby given that the Southold
Town Trustees, as lead agency for the action described below has determined
that the project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency which
may also have an application pending for the same or similar project.
TYPE OF ACTION: UNLISTED
DESCRIPTION OF ACTION: To devegetate and fill to raise the grade to construct
a house.
LOCATION: NEW SUFFOLK AVENUE, NEW SUFFOLK
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Toxin Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.
