The aoolicant does by the acceptance of this permit, assume all resoonsibilitv for operations under-
taken pursuant to this aermit, and shaJ take ail precautions for me prevention of injuries to oersons
and oroperw resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless me Town, and its office,s, agents ana emplovees from any aha ail claims arising
from operations under this permit and any and ail acts or omissions of appiicant, his agent aha
emoioyees.
The applicant and the owner and occupants of the 2remises upon which the ooerations authorized by
· [s oermit are being conducted, do, by the acceptance of this permit, give consent to the Town. and
make SUCh inspections as the Town may deem necessary' to insure that SUCh ooerations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
ration or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G, Change the course of any channel or the natural movement or flow of any waters.
H, Weaken or undermine the lateral support of other lands in the vicinity.
Otherwise adversely affect the health, safety and general welfare of the people of the town.

Code of the Town of Southold, notice is hereby given that the~Southold
Town Trustees, as lead agency for the action described below has determined
that the project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency which
may also have an application pending for the same or similar project.
TYPE OF ACTION: UNLISTED
DESCRIPTION OF ACTION: To devegetate and fill to raise the grade to construct
a house.
LOCATION: NEW SUFFOLK AVENUE, NEW SUFFOLK
REASONS SUFPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor connnen~s from
those agencies.

WHEREASj Article 25 of the New York Sta.te Environmental
I~Conservatlon' ' Law (Tidal Wetlands Act) Specifically ~25-0401,
prohibits the excavation and removal of any material or the dumping
l!or filling of any material without the requisite permit; and
il WHEREAS, the Department of Environmental Conservation (DEC)
~ihas documented a violation of said statute in that Respondent caused
l~and/or permitted to be caused, the clearing and grading in and
iladjacent to a regulated t~dal wetlands area w~thout permit at New
~lSuffolk Avenue, New Suffolk, New York; and
WHEREAS, Respondent has affirmatively waived its right to a
publi'c hearing in this matter in the manner provided by law and
having consented to the en~tering and issuing of this Order, agrees to
be bound by the terms and conditions contained herein.
NOW, having considered this matter and being duly advised,
it is
ORDERED, that with respect to the aforesaid alleged violation,
there is hereby imposed upon Respondent, a penalty in the sum of
Seven Hundred Fifty ($750) Dollars, which shall be made payable to
!this Department upon execution of this Order; and it is further
ORDERED, that Respondent shall strictly adhere to the terms and
conditions outlined in Schedule A, the compliance schedule attached
hereto and made a part hereof; and it is further
ORDERED, that nothing contained herein shall be construed as
preventing the Department from collecting regulatory fees, where
applicable; and it is further
ORDERED, that in those instances in which Respondent desires
that any of the provisions, terms or conditions of this Order be
changed, it shall make written application, setting forth the grounds
for the relief sought, to the Commissioner, c/o Joan B. Scherb,
Regional Attorney, New York State Department of Environmental

Trustee Bredemeyer: You were ~n receipt of some suggested plantings, were they
acceptable to you?
Mr. Beal: Yes, they are acceptable. But, I would like to know which one I should
use the sandy soilp or /he to p soils?
Trustee Bredemeyer: I think you have the sandy soils. We would leave it up to you
which plants you want to use, provided you stabilize.
Trustee Krupski: He should use the sandy soil list.
Mr. Beal: Then you want me to use the saDdy plantings.
Trustee Krupski: Yes.
Trustee Smith: Are there any other comments? (No response) Then I will close
this public hearing.

Dear Mr. Beal:
The following action was taken by the Board of Town Trustees during their
regular meeting~.held on July 27, 1987 regarding the above matter.
WHEREAS, William F. Beal applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated May [8, i987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on July 27, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have persona~y viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFQRE, BE iT
RESOLVED that William F. Beal BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE £'OWIX OF SOUI'HOLD TO:
devegetate and fill to raise the grade to construct a house. Property is located on
New Suffolk Avenue, New Suffolk. Approval ~s granted with the provision that the
recommendations that the Trustees made regarding planting are adhered to.

This permit will expire on July 27, 198~ if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
msurance policies insuring against any liability which may arise
m the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
Please return to the Building Dept. for a determination on the need o£
any other Town Permits that may be required for this prolect.
Please remit $10.00 for Wetland Inspection fees at this time.
