I request that this be considered in conjunction with all documents submitted heretofore. The purpose of this letter is twofold. First, I wish to respond to the issue raised at the No- vembez t8, 1986 hearing relating to the environmental zmpact statement and whether it meets the alternative use requirement of the New York Environmental Conservation Law §8-0109 (2)(d). I respectfully call the Board's attention to the following portions of the environmental impact statement: 1. Draft Environmental Impact Statement (DEIS) a. Alternative Land Use (DEIS at p. 40) b. Alternative Use Family Residential (DEIS at p.40) c. No Action (DEIS at p. 41) 2. DEIS Addendum at p. 65-68 3. Final Environmental Impact Statement (FEIS) at p.4-32 These sections present alternatives to the proposed action and accordingly meet the requirements of E.C.L. §8-0109 (2)(d). Second, with respect to another issue, there have been certain inconsistencies relative to the nature of the proposed action analyzed in the environmental impact statement now be- fore the Board. Some have characterized it as a statement re- garding 5he environmental impact resulting from the presence of a motel, restaurant and marina complex while others have characterized it as one for s change of zone. My clients wish to state for the record that they are seeking a determination within the context of the former and not the latter. They seek a comprehensive finding on how the motel, restaurant and marina complex will impact on the environ- ment. Our position is that it will impact minimally, if at and when impact exists, it can be successfully mitigated. My opinion, and my opponents agree, that this FEIS relates not to a change of zone but relates to how the development itself will affect the environment. It is this context that we respectfully request the Board to consider the FEIS. Finally, time is of the essence. My clients have not per- formed substantial work on the marina in the last two years and the facility is consequently falling into a state of dis- repair. They wish to begin work as soon as practicable to re- verse this trend. I therefore urge the Board to act as promptly as possible in order for my clients to proceed with the re- habilitation of their property. Thank you for your consideration of the aforementioned. WHEREAS, The Land Use Company on behalf of Bayview Development applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 17, 1986 , and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on September 25, 1986 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT KESOLVED that The Land Use Company on behalf of Bayv±ew Development BE AND HEREBY IS GRANTED PER2~ISSION UNDER THE PROVISIONS OF THE WETLBJqD ORDINANCE OF THE TOWN OF SOUTHOLD TO: reconstruct in place approximately 1575 lin. ft. of storm damaged timber bulkhead. Said structure will be backfilled with approximately 300 cu. yds. of clean sand to be trucked in from an upland source. Property is located on Sage Road, Greenport. This permit will expire on September 25, 1987 Board of Trustees - Page 2. Bayview Development - Determination if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise mn the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project.
