Attached hereto is a copy of a certified resolution adopted
by the Southold Town Board at a regular meeting held on October
22, 1985.
This resolution states that if a Draft Environmental Impact
Statement has not been filed with respect to the application of
Enconsultants, Inc., on,half of S. Heagan Bayles, for a Wetlands
Permit, by November 22, 1985, the application shall be deemed with-
drawn and all concerned agencies notified.
The said Draft Environmental Impact Statement was not filed
in this office by November 22, 1985 and is therefore deemed with-
drawn.

Dear Mrs. Terry:
As is our custom, which we believe to'be prudent.
and courteous, we directed Mr. Haje'to submSt an
application to'the Town for ~a Wetiands permit for the
referenced project.
There is, however, no question that the project
lies outside the current town ordinance's jurisdiction.
Marsh grasses, spartina alternaflora and spartina patens
cannot, indeed do not, grow on beaches exposed to the
extreme wave energy found on the east side of Nassau
Point~ or other bay be~ches exposed to dramatic beach
avulsion, erosion and subsequent accretion. '
At the public hearings, held prior to the adopt-
ion of this o~din~ce, the stated inten~ of the ordin~ce
was to preserve those areas upland from the Town Trustee's
property i.e. the Town's bottom lands, As you know, the
courts have rul'ed that the bay bottom is owned by the
State of New York and the Town has not, since these cases
were decided, claimed ownershipof the baybottom.
Indicative of this, for example,.the Town's Control of
shellfishing in,he creeks and 'Town enclosed bays and
the State's control inPeconic Bay, Long Island Sound,
etc.
We dO not believe, therefore, that the Town has
jurisdiction in this project. If, in fact, the Town
wishes to control such projects, it must draft an
ordinanc

Dear Mr. SamuelS:
in response to your letter of October 5, ~1984 relative to the application of
Enconsultants, Inc. for Heagan Baylis for a Wetland Permit, this matter was referred
to the Southold Town Building Department, the enforcement officers under the Ordin-
ance, for investigation. Building Inspector Hindermann advised that a permit would
be required and i transmitted.this information to Enconsultants, inc. on July .10, .1984
and on July 19, 1984. an application for same was received, processed according to the
Ordinance and subsequently the Town Board declared this a Type ! action and request-
ed: the applicant to submit a Draft EnwirOnmental Impact Statement, which they are
awaiting receipt of before they may proceed further.
in your October 5th letter you request that I issue a 'no pe'rmit necessary'
letter, or an indication as to why your opinion is invalid. I believe the foregoing
paragraph indicates why your opinion is 'invalid, but in'any event, I do not have
the authoritY to issue a 'no permit necessary' letter.

Dear Mr. Smith:
On the afternoon of Thursday, August 23,1984, I read in the
Suffolk Times the Trustees' agenda for Thursday, August 30.
I could find no such lis~ing in the L,I Traveler Watchman.
As a resident of Nassau Point, I was particularly interested
in one of the items and as I had no recollection of a
previous notice of the impending review of the item, I
thought it best to see the files so that the facts could be
brought to the attention of the members of the ~Nass~Point
Property Owners Association which is holding its annual
meeting for all members on Saturday August 25. I immediately
took time off to visit the Town Hall and at 2:30 P.M. was
told that no one was available in the Trustees' Office and
that all the files were locked. While it would be an incon-
venience for me, I said that I would be back on the next
day, Friday, ~ut was told that no one would be available
on that day to show me the files. The young lady who answered
my ~aestions was Yery courteous but obviously understood my
fr~.~stration and my questioning of the policy and political
implications resulting from this situation.
This lack of availability results in a serious gap in the in-
formation to be given to the residents of Nassau Point at
their annual meeting. However, I plan to make them aware
of the situation and the reason for the lack of facts at
the meeting.
While I am not on the Board of Directors of the Association
at the present time, I have always been interested i~ the
review and action of the Trustees as they affect Nassau Point
even. to the extent that non-Nassau Point decisions might
set favorable of unfavorable precedents For as many years
as I can remember, the Board of Directors of the Association
has taken a strong position against the installation of
groins on N~ssau Point on the basis that what one landowner
gains other landox~ers lose which eventually sets up a
system of groins around the entire Point - a situation ~o
one wants. My concern is that this item asks for permission
g~ place 17 groins at 50 foot intervals or a shore length
of at least 800 feet. This is a m~or installation 'with very

important environmental and neighborhood implications - thus
my interest in presenting the facts to the one meeting held
each year for the general membership.
As members of the Nassau Point Property Owners Association
or myself may not be able to review your files in the time
remaining before your Thursday meeting, I hope that you will
delay action for a suitable period of time in view of the
unavaxlabil~ty of your staff and. the fzlesjto allow nexghbor...,
environmen~algroups and other interested parties to study
tile proposal and determine their interests and courses of
action.
This is not a miuor floating dock type of item but requires
lengthy review and comment. Please don't make a hasty
decision.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in' by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.')
C. No' operation shall be initiated by the applicant until ali permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be .accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system.. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application ~lescribing any known prior operatiOns conducted
on the premises in question and whether any priori licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board uponrequest gtf..~;~rl~ applicant f~. a permit, may waive in whole or in part,
the provisions of Article Ii, SectionalS, subdivisions,~ and ({¢rwhere it finds that nature 'of the
proposed operations are such that 'the requirements of such provisions are not necessary for a
proper consideration of a permit application.

The decision whether ~o issue a permit will be based on an evaluation of
the probable impact including cumulative impacts of the activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reaS:0nably may be expected to accrue f-rom'the activity must be balanced
against its reasonably foreseeable detriments. Ail factors which may be
relevant to the activity will be considered inG.luding the cumulative
effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food production and, in general, the
needs and welfare of the people.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING
AND MAILED TO REACH THISgOFFICE BEFORE THE EXPIRATION DATE OF THIS .NOTICE,
otherwise it will be presumed that there., are no obj ectioh's to the activity.
Any person may request, in writing to the district engineer, before this
public notic~ expires, that a public hearing be held to coll'.'ect information
necessary to consider this application. Requests for publiC hearings shall
state, with particul, arity, the reasons why a public hearing should be held.
It should be noted that information submitted by mail is considered just as
carefully in the permit decision process and bears the same weight as that
furnished at a public hearing, i

Reviews of activities pursuant to Section 404 of the Clean Water Act will
include application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authori.ty of section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456(c)),, for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit
application that the activity complies with and will be conducted in a
manner that is consistent with the approVed state coastal zone management
program. By this public notice, we are requesting the state's concurrence
with, objection t°, or waiver of the aPpliCant'S certification. No. permit
decision will be made until one of these actiOns occur. For activities
within the coastal zone of New York state, the applicant's certification

DESCRIPTION OF WORK
The applicant, S. Heagan Bayles, proposes to construct a wave deflector
field wi~h fill in Little P~conic Bay at Nassau Point, Southold, Suffolk County,
New York for erosion control. '
The wave- ector field would consist of 17 25-foot timber wave deflectors
construc~ at:appr.oximately 50-foot intervals. All the wave deflectors'~would
extend existing bulkhead. Five deflectors would be constructed landWard
of the ne of mean high water while the other 12 structures would extend seaward
of that )ine.
The beach fronts between those 12 deflectors would be filled with sand seaward
of the line of mean high water in order to minimize downdrift starvation.
Approximately 250 cubic yards of clean sand would be trucked in for this purpose.
