Barry, Esq. applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated November 16, 1989 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 25,1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will ~not affect the health, safety and general welfare of the people of the town, ~ NOW, THEREFORE BE IT RESOLVED that En-Consultants ON BEHALF OF Robert L. Barry, Esq. BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Replace (within 18") an existing high retaining wall 76' in length. New wall will be approximately 6' lower in elevation than existing wall, which will be cut lower. A second retaining wall will be built approximately 4' landward and will match existing grade elevation. Fill removed from behind old wall will be used to fill depressed area behind wall. A 25' return on the e/s and a 15' return on the w/s will be. built. This project is subject to the condtion that no fertilizer or sod covering be used on lower tier. This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. GENERAL CONDITIONS By acceptance o! this permit, the permittee agrees that the permit is contingent upon strict compli- ance with the ECL, all applicable regulations and the conditions specified herein or attached hereto. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any ) other environmentally deleterious materials associated with the project. Any material dredged in the prosecution of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. There shall be no unreasonable interference with navigation by the work herein authorized. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of EnvirOnmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former con:dition: No claim shall be made against the State of New York on account of any such removal or alteration. If granted under Article 36, this permit does not signify in any way that the project will be free from flooding. No debris is permitted in tidal wetlands. 3. If seeding or soil stabilization is impracticable due to the time of year, a temporary mulch shall be performed at the earliest opportunity when weather conditions favor germination and growth, but not more than six months after project completion. 4. Prior to the ultimate expiration of this permit the permittee will cause all fill and exposed faces to be vegetated to prevent erosion. 5. Ail peripheral rip rap berms, cofferdams, rock revetment, gabions, bulkhead etc. shall be completed prior to placement of any fill material behind such strctures. 6o Bulkhead shall be constructed within 18" of existing structure measured from face of~old sheathing to face of new sheathing (18" maximum). 7. There shall be no placement of excavated material seaward of ~xisting bulkhead. 8. No dredging or excavation will be permitted seaward of the existing bulkhead. The Department has determined that this project is a Type I action because it is within the Peconic Bay Critical Environmental Area as designated by Suffolk County. The Department has reviewed this application and has no objection to the project. Since the Town as lead agency has issued a negative declaration, we will be issuing a permit shortly'. The premises has an existing fifteen foot high bulkhead that is in the need of immediate repair. It is our desire to preserve the exisiting 'bulkhead rather than to construct a new wall. I have been advised that the causal factors creating the bulge in the existing structure are i) erosion of fill behind the bulkhead wall and 2) excessive and unnecessary top weight due to the height of the bulkhead. It is our desire to repair and preserve the existing wall 'by 1) adding back fill between the rear of the bulkhead and the land. 2) reduce the top of the existing bulkhead by approximately five feet and 3) adding ties behind the existing bulkhead into the back fill. It is our understanding that this activity will correct the structural weaknesses in the existing wall and aesthetically reduce this thirteen foot wall (more than twice the height of other bulkheads in the area) to a height more in keeping with the existing bulkheads in the community. Would you kindly advise what if any approvals would be required by your department in order to proceed with this repair work.
