Conservation Law, Pa~ 617 of Title 6 of the New York State Codes, Rules
and Regulations, and Chapter 24 of the Southold Town Code, the Southold
Town Board, as ~ead agency, does hereby determine that the action proposeo
is a T~/pe I action and is likely to have a significant effect on the enmronment.
2. That the Town Clerk shall file and circulate such determination as
required by the aforementioned law, rules and cocle.
3. 'That the Town Clerk immediately notify the applicant,. Enconsuitants,
inc., on behalf of Ludwig Backer, of this determination, and £urther request

INSTRUCTIONS FOR PERJ'AIT
A. This cpplicatioc is to be completely filled in by typewriter or ink amc submitted to the Town
Clerk q auadruolicate, accompanied by writter' permissior from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may oe made by a copy machine and attached
to the Permit Application.')
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work ~s completed must be g~ven, including o survey if required.
E. it permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by c registered land survey or Professional Engineer. The horizontal control of survey
shell be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geologice
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits .or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of ,?~St00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon requestog~f_._~ applicant for a permit, may waive in whole or in part,
the prowsions of Article II, Section~:~,'subdivisions (~ and (~rwhere it finds that nature of the
proposed operations are such that 'the requirements of such provisions are not necessary for o
proper consideration of a permit application.

The Health Department's primary environmental concern pertaining
to development is ~that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article ¥ and VI, and relevant
construction standards for water supply and sanitary sewage disposal,
These considerations are to be reviewed completely at the time of
appli?tion. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements~
The Health Department maintains our~sd~ct~o over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Article XII~ The Lead Agency is requested
