A regul ar meeting of the Southold Town Board of
Appeals was held at 7:30 PoM., Thursday, May 21~ 19~9
at the Town Clerkts Offices Main Road, southold~ New
Mork.
There were ~resent: Messrs. Robert W. Gillispie~

PUBLIC HEARING: ?:30 P.M.. Appeal No 170 - Appli-
cation of Peter Pappas~ F~ast Gillett Drivel East Marion~
New Mork, for a variance in accordance with the Zoning
Ordinance, Article IV~ Section $0~ for permission to
reduce front yard requirements on property located on
the east~side of Main Road (Route 2~)~ Orient Point,
New York~ bounded north by E. Mc Donnell~ east by E.
McDonnell, south by Parking Field and west by Main Road
( Route 2~ ). Fee paid $1~.00.
The Chairman opened the hearing by reading appli-
cation, legal notice of hearing and affidavit attesting
to its publication in the official newspaper.

CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR. HOWARD TERRY~ Building Inspector stepped forward
and explained the sketch which appeared in the file. Mr.
Terry stated that he took the measurements appearing on
the sketch and they are accurate.
Mr. Peter Pappas appeared before the Board and answered
questions.
CHAIRMAN: Are there any questions? -- Is there any-
one prewent who wishes to speak against this application?
(No one wished to speak.)
Resolution was c~ered by Mr. Rosenberg, seconded by Mr.
Grigonis, and carried, WHMREAS application of Peter Pappas
having been considered at Public Hearing No. 170 on May 21,
19%9~ and the Board finding that strict application of the
Ordinance would produce undue hardship because building was
built prior to Zoning and in making the necessary repairs
and alterations it would be necessary to move the present
building back in order that he might meet the requirements
of the 0rdinance~ which would be ~mpractical because the
lot is not deep enough. The situation is unique and would
not be shared by all properties in the immediate vicinity
because this is the only building on this side of the street,
the area being zoned "B" Business. The public convenience
and welfare and justice will be substantially served, and
the legally established or permitted use of neighborhood
property and adjacent use districts would not be substantiel ly
or permanently injured and the spirit of the Ordinance wo,,ld
be served because there is sufficient parking area on the
south and across the road~ ~nd the property on the west is
a vacant lot and to the east is open farm land, therefore

applied for.
Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
PUBLIC HEARING: 7:$% P.M.~ Appeal No. 171 - Appli-
cation of F. J. Rossi, Depot Lane, Cutchogue, New York,
for a special exception in accordance with the Zoning
Ordinance, Article III, Section 300, Subsection ll~ for
permission to erect and maintain a directional sign in
vicinity of intersection of Depot Lane and Oregon Road,
Cutchogue, New York. Fee paid $1~.00.

The Chairman opened the hearing by reading application
for special exception~ legal notice of hearing and affidavit
attestirg to its publication in the official newspaper.
After considerable discussion relative to an informal
discussion Mr. Rossi had with the Board of Appeals onApril
16~ 19~9 relative to moving a directional sign across the
street to property of the same individual~ it was
Resolved by Mr. Rosenberg~ seconded by Mr. Bergen and
carried that Mr. Rossi be permitted to move his sign across
the highway to a location opposite the old location. The
move will be from the northwest corner cf Depot Lane and
Middle Road~ Cutch~gue~ to the southwest corner of Depot
Lane and Middle Road. This sign ~ to be placed at least
five feet from any property line. It is the opinion of
the Board that this will be a more suitable location and
will not obscure visibility on the curve in the road at
that point.
Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
A copy of the above Resolution was forwarded to Mr.
Rossi.
Mr. and Mrs. Rossi appeared before the Board and
explained the purposes of the application for a special
exception. And designated the pruposed location on map.
CHAIRMAN: Is there anyone present who wishes to speak
against this application?
There being no one who wished to speak against the
application~ it was moved by Mr. Bergen~ seconded by Mr.
Grigonis and carried~ WHEREAS applicatdon of . J. Rossi~
having been considered at Public Hearing No. 171 on May 21~
19~9 and the Board finding that the public convenience and
welfare and justice will be served and the legally establish-
ed or permitted use of neighborhood property will not be
substanti~ly or permanently injured and the spirit of the
Ordinance will be observed~ therefore
~e it RESOLVED that the application be granted as
amended for permission for the Duck Point Motel to erect
a directional sign on Duck Pond Road on property of Harris.
Permission is also granted for the erection of a new dir-
ectional sign~ double faced and illuminated~ approximtely
600 feet west of the intersection of Depot Lane and Route
27A on property of Harris. All signs to be at least five
feet from any property line and are subject to revocation.
Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen~
Mr. Rosenberg, and Mr. Grigonis.

cation of William Arasimowicz, Private Road, north side
The Glo~ming~ Fishers Island~ New York, for a variance in
accordance with the Zoning Ordinance~ Article III, Section
300, Subsection 7 for permission to reduce front yard set
back requirements and build private garaSe on property
located on Private Road~ n~th side The Glo~ming, ~ishers
Island~ New York, bounded north by West Harbor, east by
E. Hedger south by G. Leone~ and west by D. Torrance. Fee
paid $1~.00.
The Chairman opened the hearing by reading application,
legal notice of hearing~ and affidavit attesting to its
publication in the official newspaper.
CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR. HOWARD TERRY~ Building Inspector: I have been over
on Fishers Island and looked at the property and made the
sketch appearing in the file. I think it is a reasonable
request and should be granted.
CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(No one wished to speak.)
Resolution was offered by Mr. Bergen~ seconded by Mr.
Rosenberg and carried~ ~~ application of William
Arasimowicz~ having been considered at Public Hearing No' 172
on May 21~ 19~9~ and the Board finding that strict appli-
cation of the ordinance would produce undue hardship because
of the unusual topography and the size of the lot which was
purchased before the effective date of the Ordinance. ~e
situation is unique and would not be shared by all properties
in the immediate vicinity because all of the other lots served
by the road leading in from the Glo~ming have a lot area. The
public convenience and welfare and Justice will be substantially
served and the lesally established or permitted use of neigh-
borhood properties and adjacent use districts would not be
substantially or permanently injured and the spirit of the
Ordinance wou~d be served because all the lots are small in
the area and there is business nearby on one side~ therefore

and carried, it was Resolved that time and place be set for
hearing on application of George Wetmore~ Island View Lane,
Greenport, New York, for a variance in accordance with the
Zoning Ordinance, Article III, Section 303~ and Article X,
Section lO00 a, for permission to reduce frontage and use
as a single lot, property located on the north side Island
View Lane, west of peconic ~y Estates Subdivision, ~eenport,
and bounded north by A. Pekunka, east by J. Wetmore, south
by Isla~ View Lane~ and west by J- Wetmore. Time and place
being 7.30 P.M. (E.D.S.T.), June $, 19~9, at the Town Clerk,s

By Resolution offered by Mr. Rosenberg, seconded by Mr.
Bergen, and carried, ~ P.M. (E.D.S.T), June ~, 19~9 at the
Town Clerk's Office, Road, Southold, New York, was set
for the hearing upon apDlication ofBlanche Clingen~ Youngs
Road, Orient, New York, for a variance in accordance with
the Zoning Ordinance, Article III~ Section 303~ and Article
E, Section lO00A, for permission to reduce frontage and use
as a single lot~ property located on the south side of Main
Road and west side Main Street, Orient, New York, and bounded
north by Main Road~ east by other lands of the applicant~
south by Kellogg, and west by Luce.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
On motion of Mr. Bergen~ seconded by ~r. Grigonis, and
unanimously carried, it was Resolved that the Board of Appeals
set 7:~0 P.M. (E.D.S.T.) June $, 19~9 at the Town Clerk's Office,
Main Road~ $outhold, New York, as time and place for hearing
~pon application of Blanche Clingen, Youngs Road, Orient, New
zork for a variance in accordance with the Zoning Ordinance,
Article III, Section 303, and Article X, Section lO00A, for
permission to reduce frontage and use as a single lot, property
located on the Main Road and west side Main Street, Orient, New
York, and bounded north by Main Road, east by Main Street, south
by Hale and Corcoran and west by other lands of the applicant.

King~ Jr.~ King Street, Orient, New York, for a special
exception in accordance with the Zoning Ordinance, Article
III, Section 303~ Subsection ll, for permission to erect
and~maintain a directional sign on the property of N. Alfred
Luce, southwest corner of Route 2~ 0ysterponds Lane, Orient,
New York.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr~ Grigonis.
On motion of Mr. Rosenberg~ seconded by Mr. Bergen
and carried, it was Resolved that time and place be set for
hearing on application of Peter Earas, Bay Avenue, East
Marion, New York, for a special exception in accordance with
the Zoning Ordinance, Article IV, Section $08, for permission
to erect and maintain a sign on the roof of premises located
on the north side of Route 2~ Greenport~ New York~ and bounded
north by Mun Water Plant, east by Mun Water Plant~ south by
Main Road, and west by A. Zipko Estate. Time and place being
8:1~ P.M. (E.D.S.T.), June ~, 19~9, at the Town Clerk's Office,
Main Road, Southold, New York.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
It was further RE~LVED, that legal notice of hearing is
to be published in the official newspaper on date of May 29~ 19~9.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
Secretary was dictated a letter to Mr. Stanley Corwin~
stating that the Board of APpeals is not yet in a position
to reach a decision on Appeal No. 169 of Claude Giovanelli
and Frederick Schultz, however a decision will be forthcoming
on May 28, 19~9.
