TOGETHER with an easement for passage between Peconic Bay Boulevard and Peconic
Bay over a certain 10 foot right of way, in common with all others now having
such right of way and those to whom hereafter such right of way and easement
may be granted; which right of pq is more particularly described as follows:
ALL that parcel of land situate near Mattituck4 Southold Town, Suffolk County,
New York, bounded and described as follows: The easterly line of subject 10
foot right of way is described as follows:
BEGINNING at a point on the southerly line of Peconic Bay Boulevard 200,20 feet
westerly along said line from the northeasterly corner of land of Haggerty Es-
tate; and running along said land of Haggerty Estate on a line parallel to the
easterly line of said land of Haggerty Estate and 200.0 feet westerly therefrom
i. South 20 degrees 23 minutes 00,seconds East 500 feet more or leas to ordinary-
high water mark of Great Peconic Bay; the westerly line of said 10 foot right
Of way in parallel to and 10.0 feet westerly from the easterly line herein de-
scribed, and rune from Peconic Bay Boulevard to Great Peconic Hay.
SAID easement is subject to the following covenants and conditions:
1. Said easement is foot travel only,
2. It shall not be obstructed in any way and the maintenance thereof shall
be the joint responsibility of all those having a right to use said
right of way for the time being. .
3. Said easement shall be perpetual and shall run with the land but no ease-
ment or rights in said right of way shall vast in the general public.
It shall be a private right of way.
Subject to covenants and restrictions of record.
BEING AND INTENDED TO BE the same premises conveyed to the Party of the First
Part by deed dated October 4, 1963 and recorded in the Office of the Clerk of the
County of Suffolk on October 8, 1963 in Liber 5428 Page 451.
