A regular meeting of the Southold To~ Board of Appeals
was held Thursday~ June 4~ 19~9~ 7:30 P.M.~ at the To~a Clerk's
0ffice~ Main Road~ Southold~ New York.
There were present: Messrs. Robert W. Gi!lispie, Jr.~
Chairman~ Robert Bergen~ Herbert Rosenberg~ and Charles
Grigonis~ Jr.
Absent: Mr. Serge Doyen~ Jr.
Also present: Mr. Howard M. TerrM~ Building Inspector
PUBLIC HEARING: ?:30 ?.M.~ Appeal No. 177 - Application
of George Wetmore~ Island View Lane~ Greenport~ New York~ for
a variance in accordance with the Zoning 0rdinance~ Article III~
Section 303~ and Article X~ Section IOOOA~ for permission to
reduce frontage and use as a single !ot~ property located on
the north side Island View Lane~ west of Peconic Bay Estates
Subdi~ision~ Greenport~ and bounded north by A. Pekunka~ east
by J. Wetmore~ south by Island View Lane~ and west by J. Wetmore.

The Chairman opened the hearing by reading application,
legal notice, and affidavit attesting to its publication in
the official newspaper.

CHAIRMAN: Is there anMone present who wis~hes to speak
for this application?
PP. Howard Terry~ Building Inspector~ stated that the
map appearing in the file is self-expianatory~ and the appli-
cation fully covers what }~. Wetmore intends to do.
CHAI~N: Is there anyone present who wishes to speak
against this application? - Are there any questions?

Resolution was offered by ~,~. Rosenberg~ seconded by ~.~.
Grigonis and carried~ whereas application of George Wetmore~
having been considered at Public Hearing No. i77 on June 4~ 19[?~
and the Board finding 'that strict application of the Ordinance
would produce undue hardship because applicant would be unable
to sell the property without the requested variance~ since it
is undersize. The situation is unique and would not be shared
by all properties alike in the immediate vicinity because there
are only two lots in the i~nediate area~ which are -andersized~
left to be sold at the present time. The public convenience
and welfare and justice will be substantially served and the
legally established or permitted use of neighborhood property
and adjacent use districts would not be substantially ~ perm-
anently injured and the spirit of the Ordinance would be served
because this is a residential ~ea where the development is
intensely developed on ~0 ft. lots~ therefore

for.

accordance with the Zoning 0rdinance~ Article !II~ Section 303~
and Article X~ Section IO00A~ for Dermission to reduce frontage
and use as a single lot~ property located on t~ south side of
Main Road~ and west side of Main Str~et~ 0rient~ New York~ and
bounded north by ~in Road~ east by Driver lands of the applicant~
south by Kellog~ and west by Luce. Fee ~aid $1[.00.
The Chairman read the legal notice of hearing~ and affidavit
attesting to its publication in the official newspaper~ and the
application for a variance.

~. Blanche Clingen~ 0rient~ New York~ stated that she
inherited the property in question and would like to sell the
easterly portion and keep the westerly portion of 'the property
for use as at present~ a garden. At the present time she has
a buyer for the easterly part of the property who~ after purcha~e~
intends to repair the house and make it a credit to the neigh-
borhood.
CHAIR~L~N: What size are the other lots in the neighborhood?
~. CLINGEN: The one next to this property is ~7 ft.
frontage~ they all are Just about as small.

Rosenberg~ and carried~ Whereas application of Blanche Clingen
having been considered at Public Hearing No. 178 on June ~
19~9~ and the Board finding that strict application of the
Ordinance would produce undue hardship because applicant
would be unable to separate this lot from the ~maining prop-
erty without the requested variance. The situation is unique
and would not bewared by all properties alike in the immediate
vicinity because this is ionmediately adjacent to a "B" Business
district and at this time there is no dwellong on the property.
The public convenience and welfare and justice will be served
and the legally established or permitted use of neighborhood
property and adjacent use districts would be substantially or
permanently injured and the spiri~ of the Ordinance would be
served because lots in the area are smaller than this one and
applicant does not plan to build on this lot at the present
time~ but continue the use as a garden as it is being used at
present~ therefore

and west by other lands of the applicant. Fee paid ~15.00.

application is similar to the previous one~ with the exception
that there is house on this easterly lot.

having been considered at Public Hearing No. 179 on J~u~e
19~9~ and the Board finding that strict application of the
Ordinance would produce undue hardship because applicant
would be unable to sell this undersized lot without the
requested variance. The situation is unique and would not
be shared by all properties alike in the i~nediate vicinity
because this is a corner lot of irregular shape~ whereas
other property in the neighborhood has a more regular s~ape.
The public convenience and welfare and justice will be sub-
stantially served and the legally established or permitted
use of neighborhood property and adjacent use districts would n
not be substantially or permanently injured and the spirit of
the Ordinance would be served because this is a residential
corner opposite and easterly from a business district and the
dwelling has been occupied for many years~ therefore

Alfred Luce, southwest corner of Route 2~ and 0ysterponds

The Chairman opened the hearing by reading application
for special e:~ception, legal notice of hearing, and affidavit
attesting to its publication in the official newspaper. Also,
letter from ~r. N. Alfred Luce, giving permission for the
location of the sign on his property.

application is self-explanatory.
There was a brief discussion held relative to the wording
which would be placed on the sign and ~. King revi~ed it
slightly from what appeared in the application.

having been considered at Public Hearing No. 180, on June %~
19~9, and the Board fi~ing that the public convenience mud
welfare and justice will be served and the legally establish-
ed or permitted use of neighborhood property will not be sub-
stantially or permanently injured, and the spirit of the
Ordinance will be observed, therefore
Be it RESOLVED, that the application be granted for
the erection and maintenance of a ~ur foot by two foot
double-faced dmrectiona! sman to be lettered ~HE .oAY HOUoE~

ing. Location of the sign is to be the southwest corner of

PUBLIC HEARING: 8:1~ P.M.~ Appeal No. 151 - Application
of Peter Karas, Bay Avenue, East Marion, New York~ for a
special exception in accordance with the Zoning 0rdinance~
Article IV~ Section ~08, for permis~ion to erect and maintain

a sign on the roof of premises located on the north side of
Route 2[~ Greenport~ New York~ and bo~naded north by MunW ater
Plant~ east by Mun Water ~lant~ south by Main Road~ and west
by A. Zipko Estate. Fee paid $1~.00.
The Chairman opened the hearing by reading application for
a special exception~ legal notice of hearing and affidavit attest-
ing to its publication in the official newspaper.

Mr. Howard Terry~ Building Inspector~ explained the location
of the property and the intened location of the proposed sign.
Mr. Karas stated that he wished to amend his application to
read "sign will be 2~ feet by 2 feet high"~ in lieu of 30 feet by
3 feet. The Board was agreeable to this amendment.
~HA~R~.~. Are there any questions members of the Board wish

MR. ROSE_¥BERG: What will be the lettering on the sign?
ici. K3LRAS: Greenport Snack Bart with a Coke bottle on one
end. Greenport Snack Bar will be 80% of the sign and the Coke
bottle will be on the south 20~ of the sign.

Resolution was offered by Mr. Grigonis, seconded by Mr. ~rgen~
and carried~ Whereas application of Peter Karas having been con-
sidered at Public Hearing No. ld9 on Juale ~ 19%9~ and the Board
finding that the public convenience and welfare and justice will
be served and the legally established or permitted use of neigh-
borhood property will not be substantially or permanently inj-~ed~ and
the spirit of ~he Ordinance will be observed~ therefore
Be it RESOLVED that the apolication be granted for the
erection and maintenance of a 2~ foot by 2 foot sign to be ere cted
on the roof of premises of Peter Karas~ north side Route 2~
Greenport. 80~ of this sign will read G~EENPG~r S!,~ACK BAR~ and
the remaining 20~ will be devoted to a Coco Cola Bottle on the
south side of the sign. This second wall sign is to take the
place of the customary standing sign. This permission is subject
~ revocation.

Mr. and Mrs. Manuel Gloria~ Ninth Street~ Greenport~ spoke
to the Board of Appeals informally relative to obt~ning access
along a right of way in the Gree~port Driving Park~ on the south
side of the railroad tracks. This right of way joins Ninth
Street and Seventh Street. This road had been surveyed~ named
and recorded but had never been opened by the Town~ and is
commonly known as Flint Street. Previously M~. Odel! Smith
had obtained permission to open the road from Lot 77 to Seventh
Street. ~.~. Gloria owns 110 feet on the road known as Flint
Etreet~ that has not been opened. The Board advised Mr. Gloria
that if he sold a lot~ then access should be applied for at that
time~ rather than obtain access to all of them at one time.
~. James Rambo appeared before the Board requesting permission
to change the location of the boat basin at Terr~ Waters as previously
granted from the southeast corner to a point further north which is
a low spot and would be more practical. Mr. W. Germond Coc~hran
appeared and assisted Mr. Rambo in explaining the situation. Permission
had previously been granted under date of April 27~ 1959 on Appeal
No. 158. The Board advised Mr. Rambo and M~. Cochra~ that the
procedtu'e for requesting a change in this acion would be to forward
a letter to the Board of Appeals stating their case.
Mrs Rowland H. Timm~ Pin~ Neck Road, Southold~ owner of
Tinm's~ ~ ladies ~hop in ~outhotd c~e i~ for an informal discussion
relative to a sign which had been erected on the east side of the
driveway to Tinmu's. P~s. Ti~n stated that they would like to have
the sign which directs the ~oub]ic to the rear of the premises where
there is a small antique shop. The sign would read "ANTIQD~S - In
The Rear". This sign would be erected for only three months in
the summer. The Board advised ~s. Ti~a tha~ since the sign had
been on the property in another location prior to this time~ that
it could be relocated and should be placed at ~east five feet back
from the property line.
~,~. Floyd King~ Jr. asked the Board several questions relative
to extending the business district zone across the remainder of his
property in Orient. ~. King was advised that he should apply for a
change of zone to the To'~ Board.
~. Kenneth Wells and ~. Case of the newly appointed Riverhead
Zoning Board of Appeals attended the meeting this evening to observe
how the hearings of the Board of Appeals of the Town of So~12~old were
conducted~ and as~aed questions of the Board.

The minutes of the meeting of May 28~ 19~9~ on motion of
~. Grigonis~ seconded by I~.~. Bergen~ and carried~ were approved
as submitted.
