STAN FLANNEL being duly sworn deposes and says:
I. I am one of the owners of property located at 2525 ~,aurel
Way, Mattituck, New York, for which pre-existing Certificate of
Occupancy #210371 (copy of which is annexed hereto) was issued on
January 30th 1981.
II. Annexed hereto is a survey made by Robert Kart, dated December
9, 1980, indicating the presence of a wood deck which. more properly
should be called a dock situate at the southerly end of the premises.
This structure was erected approximately thirty years ago and well
before a zoning ordinance was adopted for the Town of Southold.
The front deck attached to the main dwelling was also built approximately
thirty years ago and before zoning.
I make this affidavit based upon inspection of the survey and
upon conversations had with the prior owners, Mr. and Mrs. Lopez,
and Mr. and Mrs. Lutz.
This affidavit is made with the expectation that the building
department cf the Town of Southold will. rely upon the truth of the
assertions set forth herein in issuing an amended er i 'cate of
Occupancy.

ANTHONY T, CONFORTI, attorney at law and attorney
for STAN FLANNEL, being duly sworn deposes and says:
I. Stan Flannel is one of the owners of property situate at
2525 Laurel Way, Mattituck, New York for which Certificate of
Occupancy # 210371 was issued on January 30, 1981.
II. I represented Mr. Flannel when he purchased the premises and
prior thereto caused a survey to be made by Robert A. Kart which
disclosed a wooden deck, which I am told should more properly be
classified as a dock at the southerly end of the premises bordering
Laurel Lake.
III. I made inquiry of Mr, and Mrs. Lopez, the people from whom
Mr. Flannel purchased the property and they advised that this structure
had been there prior to their ownership of the premises and since
sometime in the early 1950's. They base there information upon conversation
had with the prior owners Mr. and Mrs. Huert Lutz.
IV. On May 8, 1984 I spoke to Adrienne Lutz one of the former owners of
the premises who re-confirmed to me that this dock or deck structure had
pre-existed the adoption of the zoning ordinance.
