KLEIN, residing at Woodcliff Drive, Mattituck, Suffolk County, New York, party of the second part, WITNESSETH, that the party of the first part, inconsideration of Yen dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part,.the heirs or successors and assigns of the party of the second part forever. ALL that certain plot, piece or parcel of land, situate, �^I lying and being in NN Mattituck, Sou o Town, Suffolk County, New York, described as follows: Commencing at a point on the northerly side of East Legion Avenue 352.89 feet west of the intersection of the northerly side of ,East Legion Avenue and the westerly side of Riley Avenue measured along the northerly side of, Eas.t ,Legion Avenue; thence northerly on a line parallel with Riley, Avenue 220 feet more or less through the Creek to land of John Boutcher; thence k westerly by and along land of. John Boutcher 60 feet more or less _ :wto a point; thence southerly on a line parallel to the westerly w side of Riley Avenue along the land of Otto Anrig 217 feet more or less to the northerly side or line of East Legion Avenue; thence easterly along the northerly side or line of East Legion Avenue 60 feet to the point or place of beginning. TOGETHER with all the right, title and interest of the grantors in and to land lying within the bounds of East Legion Avenue and the land lying in the Creek, which adjoin the above described premises on the south and north bounds, respectively. BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part by deed from Charles A. Schmidt dated September 11th, 1945 and recorded in Suffolk County Clerk's Office on September 28th, 1945 in Liber 2488 ,ot deeds, Page 542. TOGETHER with all right, title and interest, if any, of the party of the first part in and to arty streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. AND the party of the first part covenants as follows: that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the title to said premises; and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
