D. 1, ,garanacake, New York 12983, party of the first part, and JAMES J. POSTERARO and DEIRDRE POSTERARO, his wife, residing at 10 Pleasant Avenue, Port Washington, New York, party of the second part, WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being iaNb= at Mattituck, Town of Southold, Suffolk County, New York, bounded and described as follows : BEGINNING at a point on the northerly line of Legion Avenue at the southwest corner of premises herein described adjoining land of Sidor on the west; said point of beginning being North 590 28' 00" East, 74.17 ' K feet as measured along the northerly line of Legion Avenue from New _ -1 Bethany Cemetery; from said point of beginning running along said land 'T of Sidor two courses and distances as follows: (1)North 35° 14' 40" West, 150.03 feet; thence (2) Porth 59° 31' 30" East, 70 feet to land of William Newalis; running thence along said land South 35° 16' 50" East, 150.00feet to the northerly line of Legion Avenue; running thence along said line South 591 28' 00" West, 70.09 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises as conveyed by Adele C. Sterling to Stephen B. Hamilton by 'deed dated 5/8/43 and recorded 5/13/43 in Liber 2286 cp 278 and by deed from Wilfred B. Ruland dated 4/12/43 ,and recorded 5/4/43 in Liber 2284 cp 329. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the patty of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the Sense of this indenture so requires.
