THIS INDENTURE, made the 29th. day of April , nineteen hundred and seventy, 1� BETWEEN ERNEST W. WILSBERG and OLGA L. WILSBERG, his wife, both N residing at 465 West Ocean Avenue, Boynton Beach, Florida, C , C*3 both party of the first part, and ERNEST E. WILSBERG and HAROLD W. WILSBERG, r Q ' residing at Ole Jule Lane, Mattituck, New York, as tenants in common and not as joint tenants, party of the second part, t WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, Suffolk County, New York, at Mattituck, and bounded and described as follows: . BEGINNING at an iron pipe at the northeast corner of land about to be conveyed to the party of the second part which ironpipe is the following two courses and distances from a monument situate at 'the .intersection of the southerly line of Main Road and the westerly line of Bay Avenue: (1) North 6° 45' West 50.0 feet; and (2) North 6° 36' 30" West 244. 50 feet; thence fromsaid point of beginning South 6' 45' East 96.31 feet along the westerly line of Bay Avenue to a monument and lands now or formerly of Phillips; thence along said lands now or formerly of Phillips the following three courses and distances : (1) North 82° 12' 30" West 112.2 feet to a monument; (2) South 290 25' West 29. 50 feet to a monu- ment; and (3) South 51° 28 ' 30" West 56. 70 feet to a monument and lands of Pumillo; thence along said lands of Pumillo North 280 29 ' 40" West 112.35 feet to a monument and other lands of the party of the second part herein; thence along said lands of the party of the second part herein the following two courses and distances : (1) North 680 22' East 39.35 feet to a monument; and (2) North 800 53' East 177.94 feet to an iron pipe a t the westerly line of Bay Avenue, being the point or place of beginning. BEING AND INTENDED to be a part of the premises_.conveyed in a deed from Edward 0. Chapman and Frances H. Chapman dated ;October 8, 1923 to Ernest W. W41sberg, recorded in the Suffolk County Clerk' s Office in Liber 1087 of deeds, at page 45, on November 15, 1923. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second.part, the heirs or successors-and assigns of the party of the second part forever. AND the party of the first put covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
