N , 7 �dwP+r2ds 11 a party of the second part, WITNESSETH,that the party of the first part,by virtue of the power and authority given in and by said Last a will and testament, and in consideration of Thirty—nine Thousand ($392000.00) dollars, V. paid by the party of the second part,does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,situate, lying and being i*ft on Fleet's Neck at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the Northerly line of West Road distant 168. 2 feet Westerly from the corner formed by the intersection of the Westerly line of Fleets Neck Road, the Northerly line of West Road; running then South 64 degrees 47 minutes 10 seconds West along the northerly line of West Road 100.00 feet to land now or formerly of Durland; thence North 32 degrees 00 minutes 40 seconds'West along the last mentioned land and through a concrete wall 250.00 feet to land now or formerly of Williams; thence North 64 degrees 47 minutes 10 seconds East along thelastmen- tioned land 60.00 feet to land now or formerly of Anderson; thence run- ning along the last mentioned land the following two courses and dis- tances: (1) South 32' degrees 00 minutes 40 seconds East 50;00 feet; (2) North 64 degrees 47 minutes 10 seconds East 40.00 feet_to land now or formerly of Amberman; thence South 32 degrees 00 minutes 40 seconds East along the last mentioned land 200.00 feet to the northerly line of West Road, to the point or place of beginning. SUBJECT to rights of the premises on the west to use the drive- way running over the premises herein to the garage or house erected on the west. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND theparty of the first part covenants that the party of the first part has not done or suffered anything whereby the said remises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the fust part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
