Y.", surveyed February 19,'- 1927, by Otto W. Van Tuyl, licensed surveyor-, .Greenport, New York, and filed in the Office of the County Clerk,,of Suffolk County on March 25 , 1927, under file no. 192. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by Minnie Burgess , Maude B. Russell and John M. Burgess , Jr. , by deed dated January 28, 1937, and recorded in the Suffolk County Clerk's Office on January 28, 1937 , in Liber 1904 cp 181. TOGETHER with the use of a right of way 8' wide to and from Wickham Avenue to Long Creek, a branch of Mattituck Bay, to pass and repass on f o of only; said right of way commencing at the northerly junction of Middle Road and Wickham Avenue; at a concrete monument, running in a westerly direction, 8' ; thence running in a northerly direction 130 feet parallel with the boundary line of Hubert W. Klein .and Gustav Bayer, to mean high water mark of Long Creek; thence running in an easterly direction along Long Creels to land of Hubert W. Klein; thence running in a southerly direction along the westerly boundary of Hubert W. Klein 130 feet to a concrete monument; thence northerly to the junction of Middle Road and Wickham Avenue, the point- or place of beginning. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have°teen encumbered,in any way whatever, except as aforesaid. AND the party,of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if: it read "parties" whenever the sense of this indenture so requires.
