A certain parcel of land lying between the easterly end of the last above mentioned 24 foot tight-of-way known a Fox Hollow Road and the shares of Mattituck Creek bounded an described as follows: BEGINNING at a point marking the easterly end of said 24 foo right-of-way known as Fox Hollow Road at the southeasterly corner thereof where the same is intersected by the westerly line of premises now or formerly of William G. Miller; from thence S. 22° 32' 20" E. along said lands now or formerly o W.G. Miller a distance of 300 feet more or less to the shore of Mattituck Creek; running thence westerly along the shares of Mattituck Creek a distance of 50 feet more or less; runn- ing thence N. IV 07' 30" W. across the beach to the foot of the bank; running thence easterly along the foot of the bank and parallel with the shores of Mattituck Creek a distance of 40 feet more or less to a point which is distant 10 feet from the boundary line of the premises now or formerly of William G. Wertenberg, by rO Alden W. Young, C.E., and P.E. and L.S. of Riverhead, New York, dated December 2, 1953 and re-dated respectively January 13, 1954, June 26, 1954, June 29, 1954, May 23, 1957, June 7, 1957 and August 28, 1958. Said premises are hereby conveyed SUBJECT to the follow- ing covenants and restrictions: 1. That the premises shall be used for residential use only and no trade, business or commercial enterprise shall b carried on upon the premises. 2. That the premises shall not be subdivided or sold except as o. single unit or parcel. 3. That any private dwelling house to be erected or placed on said premises shall be erected only according to plans submitted to and approved in writing by william H. Wertenberg, his heirs or legal representatives. Any such private dwelling house shall contain a minimum living space of not less than one thousand square feet. No detached build- ings or structures other than the private dwelling house shall be erected or placed on said premises, excepting stock- ade for screening purposes. 4. That no house trailers, tents or temporary building shall be erected or placed on said premises. 5. That all incinerators and garbage disnosal areas shall be enclosed or screened, That no commercial vehicle shall be stored or parked on said premises bV the owner thereof. C. That no private dwelling house to be erected or place on said premises shall be set ba.cl: not less than forty feet from the fiAsterly line of Raccoon Road; there shall be two side yards one on each side of the dwelling house 'hm and no one side yard shall be less than 25o feet. 7. That no vehicles shall be parked or left to remain standing in or upon any of the rights of way hereinabove granted or upon the common beach area, nor shall any vehicle be driven over or upon the right of way leading to the shore of Mattituck Creel, except for the purpose of launching and recovery of boats.
