ABITZ, residing at Reeve Avenue, Mattituck, C ^sr New York, party of the first part, and STEVEN SKEVOFELIX and MARY SKEVOFELIX, his wife, C) both residing at 142-05 Roosevelt Avenue, Flushing, New York, party of the second part, " #" WITN9SSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part; 'does hereby grant and release unto the party of the 1 second part, the heirs or successors and assigns of the party of the second,part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being ffi at Mattituck; in the town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows ; BEGINNING at a monument situate on the northerly side of New Suffolk Avenue, which monument is situate at the southwesterly corner' of lands of George L. Penny III, and thence from said point of, beginning running North 74° 06' 30" West 46. 60 feet to another monument situate on the northerly side of New Suffolk Avenue; thence running along the northerly side of New Suffolk Avenue North 81 01' 30" West 53.40 feet to other lands now or formerly of Audrey T. Abitz; thence along said other lands now or formerly of Audrey T. Abitz North 19° 28' 50" East 200.26 feet to a monument and other lands now or formerly of John F. Parkin; thence along said other lands now or formerly of John F. Parkin North 860 39 ' 40" East 100.00 feet to a monument and lands now or formerly of George L. Penny III; thence along said lands now or formerly of George L. Penny III South 17° 45' 10" West 226. 50 feet to the point or place of beginning. . SUBJECT to covenants, restrictions, reservations and agreements of record, and, SUBJECT to any state of facts that an accurate survey may show. The grantor herein is one and the same person as one of the grantees in the deed dated October 11, 1951, recorded in the Suffolk County Clerk' s Office on October 16, 1951, in Liber 3277, cp 485. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party- of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
