`WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party ofthe second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,

BEGINNING at a point on the Southwesterly line of Westphalia

said point or place of beginning is where the division line
between the premises herein described and land now or formerly of
North Fork Oil Heat Co. intersects the Fouthwesterly line of

RUNNING THENCE alon last described land the following two
courses and distances: 1)South 19 Degrees 1minutes west
105.85 feet; and (2) South 45 degrees 05 minutes west 68.15 feet
to land now or formerly of Penny;
THENCE North 48 degrees 17 minutes West, along the last
~ descriiaed land 49.06 feet to land now or formerly of Charkow;
THENCE North 19 degrees 16 minutes east along the last
described land 148.47 feet to the Southwesterly side of
Westphalia Avenue;
THENCE South 70 degrees 44 minutes east, along the southwesterly
side of Westphalia Avenue 75.00 feet, to the point or place of
BEGINNING.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the partyof the second part forever.

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
.' AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
!' the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apph
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
