vivorship thereof and not as tenants in common, of premises de-
scribed in deed recorded in Liber 5567 cp 92 on the 29th day of

All of said equal undivided one-third interest of the party of the
first part herein in and to all that certain plot, piece or parcel
of land, with the buildings and improvements thereon erected,
situate, lying and being at Mattituck, in the Town of Southold,
County of Suffolk and State of New York, known and designated as
lot #41 and parts of lots 40 and 42, Block 2, on a certain map en-
titled, -14ap of Captain Kidd Estates,' and filed in the Office of
the Clerk of Suffolk County on January 19, 1949 as Map 1672, which
said lot and part of lots when taken together are more particularly
bounded and described as follows:
BEGINNING at a stake on the northerly side of Sound Beach Drive
distant 949.82 feet southwesterly along the northerly side of Sound
9each Drive from a monument at the point of tangent of the arc of
a curve having a radius of 25 feet connecting the northerly side of
Sound Beach Drive with the westerly side of Inlet Drive. and from
1I said point of beginning running thence southwesterly along the
northerly side of Sound Reach, South 570 30' West a distance of
100.345 feet to a point; thence northwesterly through lot 40, North
380 West a distance of 171.76 feet to a stake at the high water
mark of Lung Island Bound; thence northeasterly along said high
water mark, North 52 East a distance of 100 feet to a stake; thence
southeasterly through lot 42, south 380 East a distance of 181.395
fi feet to a stake on the northerly side of Sound Beach Drive, to the
point of place of BEGII'NING.
THIS PROPERTY is subject to zoning, building and health laws and
regulations of the Town of Southold and the State of New York, and
any government agency having jurisdiction. Water supply and
sewerage disposal shall be in accordance with the plans approved by
the New York State Department of Health.
No building shall be erected unless the plans and specifications
' have been approved in writing by the seller.
No business of any kind is to be conducted on the premises.

June 18, 1964, and recorded in Liber 5567 cp 92 in the Suffolk
County Clerk's Office on the 29th day of June, 1964 at 4:20 p.m.,
executed by Andrew Tafuri and Louise Tafuri, his wife, as grantors.
The conveyance herein is subject to a certain purchase mPhilomena
mortgage executed by the above-named Edward B. Kiernan,
M. Kiernan, his wife, Eugene F. Kiernan and Stella Kiernan, his
wife, and Ann Townsend, in the amount of $12,500.00 simultaneously
with said deed recorded in Liber 5567 cp 92 and recorded simultan-
eously therewith in Liber 4405 of Mortgages at Page 175 to said
Andrew Tafuri and Louise Tafuri, his wife, which mortgage is dated
June 18, 1964 and on which mortgage there is now due the sum eOfannum
with interest thereon at the rate of 6% p
from and that the grantees herein hereby assume
and "covenant to pay such mortgage debt and interest as part of the
consideration for this conveyance.
