ER65175 PAGE 88 THIS INDENTURE, made the 12th day of June nineteen hundred and sixty nine BETWEEN Milian B. Sterling, and Helen S. Tuthill , both residing J� at Cutchogue , Suffolk County, New York, both individually and as executors of and trustees tinder the last will and testament of Ralph Cl. Sterling, deceased, party of the first part, and Alfred R. Livett, and Jennie S. Livett, his wife , residing at Bay Avenue , Cutch.ogue , New York, C party of the second part, a y vti WITNESSETH, that the party of the first part, in consideration ofd dollarpipaid by the party of the second part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors and 44 assigns of the party of the second part forever, .di ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being in the Town of Southoid, Suffolk Count , New York, near Nassau Point, known and designated as lots ntuners 111 and 112 on a certain map entitled "T,'ap of Nassau Fammts , situate in Peconic , Suffolk County, New York, Otto 'if. VanTuyl , L.S. ,Greenport, NY" and filed in Suffolk County Clerk ' s office on Yar. 28, 1935 as Map No. 1179 . Also that parcel of land shown on said map of Nassau Farms , lying immediately opposite and across Bay Avenue from said Lots 111 and 112 abovementioned, which said parcel is bounded and described as follows ; Beginnin- at a point on the west side of Bay Avenue where the same would be intersected by the south line of lot x`112 if extended in a straight line westerly across Bay Avenue to the east side of Baldwin Creek_; run- ning thence from said point of beginning westerly along said south line of Lot 'x112 as extended to the high water line on the east side of Baldwin Creek; running thence northerly along the high water line of Baldwin Creek to the north line of abovementioned lot 71,4111 if extended in a straight line westerly across Bay Avenue to the east side of Baldwin Creek; running thence easterly along said north line of said of #111 as extended to the west side of Bay Avenue , and running thence S outherly along the west side of Bad= Avenue 140 feet to the point or place of beginning. This bein a correction deed being intended to correct the des- cription contained in a certain deed from Ralph T. Sterling (then in his lifetime ) to Grace Jung and Theodore Jung, her husband, by deed dated October 11, 1941s recorded Liber 2195 cp 311, in which the above described parcel on the west side of Bay Avenue was emitted; and the said Theodore Jung having died, and the said Grace Jun-, his widow I aving, conveyed the premises to the party of the second part by deed dated Nov. 13, 1957, recorded Liber 4393 cp 295. Together with all the right title and interest of party of the first part if any in and to Bav Avenue abutting said premises and in and to the watersandlands under water of Baldwins Creels adjoining said premise: TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part,in compliance with Section 13 of the Lien Law,hereby covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
