THIS INDENTURE, made the 28th day of August , nineteen hundred and sixty nine BETWEEN Alfred R. Livett, and Jennie S. Livett, his wife, residing at Bay Avenue, Cutchogue, New York, + ^ party of the first part, and Q Donald C . Van Tuyl , L.S. , Greenport, NY" and filed in the Suffolk County Clerk' s office on Yarch 28,1935 as Nap No. 1179 . Pa . cel 2. All that described plot, piece or parcel of land with the improve- ments thereon shown on said Map ofblassau Farms , filed in Suffolk County Clerk' s office on March 28,1935 as Map #1179 , and lying immediately opposite and across Bay Avenue from said lots 111 and 112, in Parcel 13 abovementioned, which said parcel is bounded and described as follows; Beginning at a point on the west side of Bay Avenue where the same would be intersected by the south line of Lot #112 if extended in a straight line westerly across Bay Avenue to the east side of Baldwin Creek, running thence from said point of beginning westerly along said south line of Lot #112 as extended to the high water line on the east side of Baldwin Creek, running thence northerly along the high water line of Baldwin Creek to the north line of the abovementioned lot #111 if extended in a straigh- line westerly across Bay Avenue to the east side of Baldwin Creek, running thence easterly along said north line of said Lot #111 as extended to the crest side of Bay Avenue , and running thence southerly along west side of Bay Avenue 140 feet to the point of beginning. Together with all the right, title and interest of party of the first part to the waters and 18 nds under water of Baldwins Creek adjoining the premises . Tuthill, etc , by correction deed dated June 122 1969, recorded Libor 6575 ep 88 TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, th;- hc:, or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the saine first to the payment of the cost of the improvement before using any 1»rt of the total of the same for any, other purpose.
