State of New York, bounded and described as follows ;
BEGINNING at a point on the southwesterly side of West Creek Avenue
distant 404. 59 feet southeasterly from the corner formed by the
intersection of the southwesterly side of West Creek Avenue with
the southeasterly side of Old Pasture Road; running thence along the
southwesterly side of West Creek Avenue, (1) Southeasterly on a
curve to the right having a radius of 132. 32 feet a distance of
95. 61 feet and (2) South 3° 56' 20" East, 4. 39 feet; thence along
land now or formerly of Miller, (1) South 510 07' 20" West, 121.35
feet and (2) South 490 27' 30" West, 280 feet to the highwater mark
of Wickham Creek; thence along said highwater mark on a tie line of
North 620 47' 30" West, 64. 63 feet and thence North 45° 40' 30" East,
along land now or formerly of C. Fleet and land-now or formerly of
Katherine Fleet, 455 feet to the southwesterly side of West Creek
Avenue and the point or place of BEGINNING.
TOGETHER with all right, title and interest, if any, of the parties
of the first part to land under water to the ordinary highwater mark
of Wickham Creek.
SUBJECT to any state of facts that an accurate survey may show.
BEING AND INTENDED TO BE the same premises conveyed to the parties
of the first part by deed recorded in the Office of the Clerk of the
County of Suffolk in Liber 6653, page 298.
The conveyance hereunderis subject to a certain mortgage executed by
IiWilliam Ross Clark, Jr. and Diana D. Clark, his wife, as mortgagors,
to Southold Savings Bank, as mortgagee, which mortgage is dated
April 18, 1967, recorded in the Office of the Clerk of the County
of Suffolk in Liber 5138, page 230, and on whichmortgage there is
