�n THIS INDENTURE, made the 29th day of April nineteen hundred and seventy-one, _
BETWEEN ARTHUR J. BALDWIN and FRANCES K. BALDWIN, his wife, both
residing at Cox Neck Road, Mattituck, New York,
party of the first part, and FRANK ZABICKY and AGNES ZABICKY, his wife, both
residing at Main Road, Aquebogue, New York,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con-
sideration paid by the party of the second part, does hereby grant and release unto the party of the
-� second part, the heirs or successors and assigns of the party of the second part forever,

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,

r of Suffolk and State of New York, bounded and described as follows:
"NIPBEGINNING at a point on the westerly side of Cox Neck Road where
the same is intersected by the northerly side of land now or formerly
E of Stanley Becker which said point of beginning is North 100 51' 40"
r West 288 . 78 feet from the intersection of the northerly side of
Westphalia Road with the easterly side of Cox Neck Road and from said
point of beginning as so located and defined; RUNNING THENCE South 89*
00' 20" West along said land now or formerly of Stanley Becker
125.00 feet to land now or formerly of William Chudiak; THENCE
North 0° 59 ' 40" West along said land now or formerly of William
Chudiak 200.00 feet to land now or formerly of Phillip Neudeck;
THENCE North 890 00' 20" East along said land now or formerly of
Phillip Neudeck 125. 00 feet to the westerly side of Cox Neck Road;
THENCE South 0° 59 ' 40" East along the westerly side of Cox Neck Road
200. 00 feet to the point or place of beginning.
SUBJECT to any state of facts that an accurate survey may show.
The conveyance hereunder is subject to a certain mortgage executed
by Arthur J. Baldwin and Frances K. Baldwin, his wife, as mortgagors,
to Suffolk County Federal Savings and Loan Association, as mortgagee .
which mortgage is dated October 24, 1967, recorded in the Office of
the Clerk of the County of Suffolk in Liber 5268, page 431, and on
which mortgage there is now due the sum of $15 . 164.03 with interest
thereon at the rate of Six (61.) Per Cent per annum from April 1,
1971, and that the grantees hereby assume and covenant to pay such
mortgage debt and interest as part of the consideration for this
conveyance.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof: TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered any-
thing whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
