PENNY, g �. number) , Mattituck, New York and FLORA S. LUCE, residing at Bay Avenue (no number) , East Cutehogue , New York, hereinafter described ; as parties of the first part, and JOHN A. SNEE and DORISS J. SNEE, his wife, residing at 246-77 87th Avenue, Bellerose-, New York, here - inafter described as the parties of the second part, and WHEREAS the parties of the second part are now owners of a certain parcel of land conveyed to them by the parties of the first part on January 3, 1969 by deed which was recorded in the Office Of the Clerk of Suffolk County on January 13, 1969 in Liber 6487 cp 5E19 which premises are subject to a Declaration of Covenants-gnd e strictions dated March 14, 1966 and recorded April 1, 1966 in Libe •�,epr 5934 cp 509, and C� WHEREAS the parties of the second part are now the owners of said land described as follows : ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, in the Town of Southold, f Suffolk and State of New York, being known and County o 1 designated as and by the Lot #5 on a certain map entitled, "Map of Hickory Acres, Section #1'' .and Filed in the Office of the Clerk of the County of Suffolk on April 20, 1961 as Map No. 3325 WHEREAS the parties of the second part have requested the parties of the first part to modify Paragraph 7 of said Covenants and Restrictions which read as follows : "No dwelling house or garage shall be erected or main- tained on any lot having a street frontage of less than one hundred (100) feet, and no part of any dwelling house or garage, including steps, stoops and porches, shall be erected or maintained within for (40) feet from the other front sideline or within fifteen (15) feet from any boundary of the lot. No part of any cesspool or se tic tank shall be within ten (10) feet of any of said lot. NOW, THEREFORE, in consideration of One Dollar paid by the ( ; parties of the second part to the parties of the first part, the receipt of which is hereby acknowledged, the parties of the first part hereby modify Paragraph 7 of said Covenants and Restrictions S-368054 r RECORDED cM M.
