CHARNEWS and EDWARD CHARNEWS, JR. , her son, both residing at Main Road, Peconic, Suffolk County, New York, party of the first part, and WILLIAM JACOBS and ALBERTA M. JACOBS, his wife, both residing at 311 Pine Street, Freeport, New York, .. r party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable con- sideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, \t5 ALL that certain plot. piece or parcel of land, with the buildings nd improvements thereon erected, LL situate, lying and being kxdax at Cutchogue, Town of Southold, County of Suffolk and State of New York, bounded and described as follows : BEGINNING at a monument on the northeasterly side of Depot Lane at the intersection of the southwesterly corner of premises herein des- cribed and the northwesterly corner of land formerly of Elizabeth R. Br now or formerly of Drake, said monument also being distant "9 56.83 feet northwesterly from the corner formed by . the intersection or-the- northeasterly side of Depot Lane and the northwesterly side of Main Road and running thence North 41° 33' 00" West along the northeasterly side of Depot Lane 99.0 feet to a monument and land formerly of Elizabeth R. Brown now or formerly of Kapusta; THENCE North 41° 45' 00" East along the last mentioned land 214. 5 feet to a monument and land formerly of Elizabeth R. Brown, now or formerly of Bialecki; THENCE South 41° 33 ' 00" East along the last mentioned land 99.0 feet to other land formerly of Elizabeth R. Brown, now or formerly of Drake; THENCE ort 41° 45' 00" West along the last mentioned land 214. 5 feet to the monument on the northeasterly side of Depot Lane at the p nt or place of beginning. SUBJECT to any state of facts that an accurate survey may show. BEING the same premises conveyed to the party of the first part by deed from Stanley J. Ambroski dated 6/30/65, recorded 7/1/65 in Liber 5771 cp 449. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered any- thing whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part,in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
