THIS INDENTURE., made the 7 day of nineteen hundred and seventy

duly organized and existing under the Lawsof the State of New York,

under the Last Will and Testament of William V. Durvee, formerly of

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

of Suffolk and State of New York, bounded and described as follows: .

Q BEGINNING at a point on the northerly side of West Road, distant
100 feet easterly from a monument set at the corner formed by the
intersection of the northerly side of West Road and the easterly
side of West Creek Avenue; running thence northerly at right angles
to West Road along land formerly of Hamilton and Duryee, a distance
of 223.12 --feet; running thence North 47 degrees 04 minutes 40 seconds
East 45. 70 feet more or less to land of Brengel; running thence North
26 degrees 16 minutes 50 seconds west 1.93 feet to land of Fred Ypung;
a running thence South 47 degrees 04 minutes 40 seconds West along land
Z Of Fred Young 52.15 feet ; thence South 26 degrees 16 minutes 50 seconds
East 223.12 feet to .the northerly side of West Road at the point of
BEGINNING.
The North Fork Bank & Trust Company, one of the parties of the first
part ,is the successor in interest to the Mattituck National Bank.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part;in compliance with Section 13 of the Lien Law,hereby covenants that the party "
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
t any other purpose.
The word "party" shall.be construed as if it read "parties" whenever the sense of this indenture so requires.
