lLJl/ WITNESSETH, that the party of the first part, in consideration of ten dollars paid by the party of the second
part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
dying and being in the Town of Southold, County of Suffolk and State of New
i York, being bounded and described as follows:
BEGINNING at a point on the southerly side of a 50 foot right of way
which point also intersects a 16. 5 foot right of way and lands now
or formerly of Helen and Raymond Kirsch; thence from point of
beginning along said lands now or formerly of Kirsch, South 4
degrees 40 minutes 30 seconds East, 212. 60 feet to the mean high
water line of Corey Creek as it appeared on 2-25-88; thence along
said mean high water mark, South 28 degrees 50 minutes 00 seconds
West, along a tie line, 50.61 feet to lands now or formerly of
Lindtveit,' thence along said lands, North 18 degrees 30 minutes 00
seconds West, 199.97 feet to the southerly side of a 50 foot right
of way; thence along said right of way North 46 degrees 38 minutes
5.0 ,seconds East 97. 00 feet to the point or place of BEGINNING.

TOGETHER with a non-exclusive right of way 50 feet wide along the
1 northwesterly line of the premises to Main Bayview Avenue for
f ingress and egress. Also with a non-exclusive right of way 16.5
feet wide from the northeasterly corner of the premises easterly and
then northeasterly about 629 feet to Bayview Road for ingress and
egress and utility service.
BEING the same premises conveyed to the parties of the first part by
deed dated August 17, 1990 and recorded in the Office of the Clerk
of the County of Suffolk on August 29, 1990 in Deed 11128, page 118.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
PLY, \A roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
Lo� HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
