York 11792, party of the first part,and DONALD P. BRICKLEY and PHYLLIS BRICKLEY, his wife, both residing i at 144 Shore Avenue, Quincy, Massachusetts 02169, i party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs i':or successors and assigns of the party of the second part forever, t X ALL that certain plot, piece or parcel of land, situate, R r ,-lying and beingitkft at Peconic, near Nassau Point, Town of Southold, Suffolk C- 1, County, New York, bounded and described as follows : BEGINNING at the intersection of the southerly line of Bay X Avenue with the easterly line of Broadwaters Drive; , from said point of beginning running along said southerly line of Bay Avenue, three courses as follows : 1. North 790 12 ' 10" East 13.40 feet; u 2. South 870 01' 10" East 200.50 feet;, ° 3. North 750 46' 30" East 293.23 feet to a monument; ° running thence South 12° 08 ' 10" East ?69.78 feet to a monument ei marking the intersection of the northerly line of Oak Drive with the easterly line of Hickory Drive; , running thence along the said northerly line , of Oak Drive South 790 12 ' 10" West 500.13 feet to the intersection of the easterly line of Broadwaters Drive with the northerly line of Oak Drive; running thence along the said easterly line of Broadwaters Drive North 120 08 ' 10" West 300.0 feet to Bay Avenue at the point of BEGINNING. A purchase money mortgage of even date herewith was delivered by the grantees to the grantors herein in the amount of $8,875.00 in part payment of the purchase price of these premises. li TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO ,HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except rs aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sen-: of this indenture so requires.
