Mueller and G. Irene Mueller; running thence along said line North 160 34' 30" West, 216.43 feet to land of Watts ; running thence North 73125' ` 30" East, 71.81 feet to land of Davids ; running thence along said land South 160 34' 30" East, 211. 37 feet to the northerly line of Bay Avenue ; $ V running thence along said line South 69° 23' 50" West, 72 feet to or at the place of BEGINNING. PARCEL II: BEGINNING at a point on the westerly line of Bay Avenue 173+58 feet southerly along said westerly line from the southerly line of Sterling Road said point of beginning being the southeast corner of land of Mueller and the northeasterly corner of the premises herein des- cribed; from said point of beginning running along said westerly line of Bay Avenue, 25 feet to land now or formerly of Horton; running thence along land now or formerly of Horton in a westerly direction to ordinary high water mark of Mudd or Baldwins Creek; running thence northerly along said high water mark 25 feet, more or less, to land of Mueller; running thence easterly along said land of Mueller to the point or place of BEGINNING. TOGETHER with all right, title and interest of the -party of the first part of, in and to land below high water mark and under waters of Mudd or Baldwins Creek adjacent to said premises. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
