THIS INDENTURE,made the 7th day of July nineteen hundred and Seventy-two
BETWEEN HILDE HERFURTNER, residing at 154-36 Tenth Avenue,
Beechhurst, N. Y. , being the grantee named in deed recorded in

BEGINNING at a monument set at the southwest corner of the premises ,,
herein described, at the point of intersection of the easterly aide of
of Luther' s Road with the northerly line of land now or formerly of
Rachel M. O. Ward; running thence along the northerly line of the
land last mentioned, north 65 degrees 54 minutes 10 seconds east,
310. 74 feet to a corner; thence north 43 degrees 45 minutes west
430.57 feet to the easterly side of Luther's Road; thence south
16 degrees 43 minutes east along the easterly side of said road,
60 feet to an angle in said road; thence continuing along the
easterly side of said road, south 0 degrees 47 minutes west,
381.10 feet to the monument at the point or place of beginning.
TOGETHER with all the right, title and interest of the party of
the first part, of, in and to the land under the water of Mattituck
Inlet lying in front of and adjoining part of said premises on the
East, and all other lands adjacent to said premises presently owned
by the party of the first part, if any.
Also together with all the right, title and interest of the party
of the first part, of, in and to Luther's Road adjoining said
premises above described.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
rT1 roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
C14:11 and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
C:) HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.

m AND the party of the first pant covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
ANI) the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
f any other purpose.
